{"data":{"id":"us-ky/krs-77.065","jurisdiction":"us-ky","citation":"KRS 77.065","heading":"County officers are ex officio officers and other personnel of district --","body":"Exception for county containing city of first class or consolidated local\ngovernment or county where largest city has population of 20,000 or more --\nEffect of compact -- Employees of district upon establishment of consolidated\nlocal government.\n(1) The members of the fiscal court of a county shall be, and they are hereby designated\nas, and empowered to act as, ex officio the air pollution control board of the air\npollution control district in such county.\n(2) All county officers, their assistants, clerks, deputies, and employees, and all other\ncounty employees shall be ex officio officers, assistants, deputies, clerks, and\nemployees respectively of the air pollution control dis trict in the county in which\nthey are employed. Except as otherwise provided in this chapter, they shall perform\nrespectively the same various duties for the air pollution control district as for the\ncounty without additional compensation, in order to carr y out the provisions of this\nchapter.\n(3) The provisions of subsections (1) and (2) of this section shall not be applicable to\nany county containing a city of the first class, or a consolidated local government, or\nto a county where the largest city in tha t county contains a population equal to or\ngreater than twenty thousand (20,000) based upon the most recent federal decennial\ncensus.\n(4) Notwithstanding any provision of this chapter to the contrary, whenever a city of the\nfirst class and a county contain ing such city have in effect a compact under KRS\n79.310 to 79.330, the county shall provide all staff support, including a secretary -\ntreasurer and an air pollution control officer, to the air pollution control board\nthrough county officers, assistants, clerks, deputies and employees. In such case, the\nstaff of the air pollution control board, including the secretary -treasurer and the air\npollution control officer, shall be deemed county employees and shall be subject to\nthe control of fiscal court. At the t ime the compact takes effect, the employees of\nthe air pollution control district shall be transferred to the service of the county\ngovernment; provided that all such employees who are in the classified service at\nsuch time shall be continued in the classi fied service administered by county\ngovernment. Upon the establishment of a consolidated local government in a county\nwhere a city of the first class and a county containing that city have had in effect a\ncooperative compact pursuant to KRS 79.310 to 79.33 0, the employees of an air\npollution control district shall be deemed to be employees of the consolidated local\ngovernment and the provisions of this subsection shall be applied to the\nconsolidated local government.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43652","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"20b45fe3f7a178d22e6231d1ba7ad84eb286f49bbe8d606e96990331bf469c10","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.060","next":"us-ky/krs-77.070"},"notice":"GroundRules: Original legal text.
