{"data":{"id":"us-ky/krs-77.115","jurisdiction":"us-ky","citation":"KRS 77.115","heading":"Air pollution control board is governing body of district -- Duties,","body":"responsibilities, and regulatory authority of board -- Vehicle exhaust testing\nprogram -- Limitations -- Exemptions.\n(1) The air pollution control board is hereby declared to be the governing body of an air\npollution control district, and shall manage and control all the affairs and property\nof such district, and shall exercise all the powers of such district not otherwise\ndelegated by this chapter. In a county where a city -county comp act under KRS\n79.310 to 79.330 is in effect or in a county where a consolidated local government\nhas been established, the air pollution control board shall assume all of the duties\nand responsibilities of the hearing board appointed under KRS 77.105, and the\nhearing board shall be abolished.\n(2) Notwithstanding any provision of this chapter to the contrary, in a county where a\ncity-county compact under KRS 79.310 to 79.330 is in effect or in a county where a\nconsolidated local government has been establish ed, the air pollution control board\nshall have regulatory authority for the district, and the city, consolidated local\ngovernment, or county, as appropriate, shall exercise funding and administrative\ncontrol of the district.\n(3) If an air pollution control  board finds the need for and requires the implementation\nof a vehicle exhaust testing program, the program shall prohibit emissions of,\nregulate, or control only mobile sources of air pollutants regulated under the state\nprogram established in accordance with KRS 224.20-710 to 224.20-765.\n(4) In a county where the air pollution control board makes a finding of a need for and\nrequires the implementation of a vehicle exhaust testing program, the board shall\nexempt from the program vehicles registered to mili tary personnel on active duty\nwhose duty station is outside of the county.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24622","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"1e4d22b0e8d031a91c642e89f67327b9f6b27204ee9a6cbd375f567a09e464dd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.110","next":"us-ky/krs-77.120"},"notice":"GroundRules: Original legal text.
