{"data":{"id":"us-ky/krs-77.127","jurisdiction":"us-ky","citation":"KRS 77.127","heading":"Air quality trust fund.","body":"(1) In a county containing a consolidated local government or a city of the first class or\na city having a population equal to or greater than twenty thousand (20,000) based\nupon the most recent federal decennial census, there is established within the air\npollution control district a special trust fund to be known as the \"air quality trust\nfund\" to be used for conducting and funding air quality research and development\nprojects, special nonrecurring air quality projects, and air quality education\nprograms approved by the air pollution control board to assist in implementing the\npolicies and purposes of this chapter.\n(2) All money collected for the fund shall be deposited by the district into an interest -\nbearing capital project account maintained by the fiscal c ourt or consolidated local\ngovernment of the county in which the district is located. Money shall be distributed\nfrom the account by the finance director of the county or consolidated local\ngovernment based upon written authorization from the air pollution  control board.\nMoney unexpended at the close of a fiscal year shall not lapse but shall be carried\nforward for future use.\n(3) The fund shall not be used to support or finance the routine day-to-day activities and\nresponsibilities of the district.\n(4) The air pollution control board shall, by regulation, set policies and establish\nprocedures for the receipt and disbursement of any money collected under this\nsection and for the full disclosure of the source and use of the money.\n(5) The air pollution control board shall control and manage the fund. It shall publish in\nwriting at its June meeting each year an accounting of the income and\ndisbursements of the fund.\n(6) Four (4) members of the air pollution control board shall constitute a quorum for\nconducting business relating to the air quality trust fund. When votes are taken on\nmatters relating to the fund, each member shall have one (1) vote, and the\naffirmative vote of at least a majority of the votes cast shall be necessary for the\nadoption of any motion, measure, or resolution.\n(7) Members of the air pollution control board shall not solicit, but may accept, money\nby grant, gift, donation, bequest, civil or criminal penalty, or other conveyance to be\ncredited to the air quality trust fund, but they may n ot accept penalties collected\nunder KRS 77.990 for the air quality trust fund.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43658","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"5262792325b3dfa5b1c6552370c0f714b69758189d327e275e9471ee26c138a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.125","next":"us-ky/krs-77.130"},"notice":"GroundRules: Original legal text.
