{"data":{"id":"us-ky/krs-77.160","jurisdiction":"us-ky","citation":"KRS 77.160","heading":"Operations exempted from provisions of KRS 77.155.","body":"The provisions of KRS 77.155(1) and (2) shall not be applicable:\n(1) To buildings used exclusively for single owner -occupied private residences.\nHowever, the provisions of KRS 77.155 shall be fully effective and applicable if a\nrenovation, demolition, or c leanup of a building may cause a disturbance of\nasbestos material and:\n(a) The building is one (1) of a group of buildings consisting of more than one (1)\nbuilding under common control; or\n(b) At the time of the renovation, demolition, or cleanup, the use of the building\nor the property is commercial or is not known. To all larger residential\nbuildings of whatever type, KRS 77.155 shall be effective and applicable;\n(2) When a firebox, furnace, boiler, locomotive, or other fuel -consuming device is\nbeing cleaned out and a new fire is being built therein, in which event a smoke of a\ndensity as great or greater than that established by regulation by the air pollution\ncontrol board shall be permitted for a period not to exceed six (6) minutes in any\nsingle period of sixty (60) minutes;\n(3) To equipment used for agricultural operations in the growing of crops, or raising of\nfowl or animals; or\n(4) To smoke from fires set by or permitted by any public officer if such fire is set or\npermission given in the performanc e of the official duty of such officer for the\npurpose of weed abatement, the prevention of a fire or health hazard, or the\ninstruction of public employees in the methods of fighting fire, which is, in the\nopinion of such officer, necessary.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56257","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"64107bc89a8b17857eed40faa804213b7ffa9b38bef65d1c69ab6fd85a8b2c41","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.155","next":"us-ky/krs-77.165"},"notice":"GroundRules: Original legal text.
