{"data":{"id":"us-ky/krs-77.170","jurisdiction":"us-ky","citation":"KRS 77.170","heading":"Stricter local regulation not preempted -- Local ordinances not superseded -","body":"- Exceptions.\n(1) Except for subsection (3) of this section, the General Assembly does not, by the\nprovisions of this chapter, intend to occupy the field except for requiring a  county\nair pollution control board to exempt from the requirements of a vehicle exhaust\ntesting program vehicles registered to military personnel on active duty whose duty\nstation is outside of a county. Except for subsection (3) of this section, the\nprovisions of this chapter do not prohibit the enactment or enforcement of any local\nordinance stricter than the provisions of KRS 77.150 to 77.180 and stricter than the\nrules and regulations adopted pursuant to KRS 77.180 to 77.240, which local\nordinance prohibits, regulates, or controls air pollution.\n(2) Except for subsection (3) of this section, and except for requiring a county air\npollution control board to exempt from the requirements of a vehicle exhaust testing\nprogram vehicles registered to military p ersonnel on active duty whose duty station\nis outside of a county, the provisions of this chapter do not supersede any such local\nordinance. If it should be held that the provisions of this chapter supersede the\nprovisions of any local ordinance, such susp ension shall not bar the prosecution or\npunishment of any violation of such ordinance which violation was committed\nwhen such ordinance, was in full force and effect.\n(3) Local ordinances prohibiting, regulating, or controlling emissions from mobile\nsources of air pollutants shall prohibit emissions of, regulate, or control only mobile\nsources of air pollutants regulated under the state program established in accordance\nwith KRS 224.20-710 to 224.20-765.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24634","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"a60c740fadc526ff0ac054dcd24db074a99c0468c59b0769437732c66761561c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.165","next":"us-ky/krs-77.175"},"notice":"GroundRules: Original legal text.
