{"data":{"id":"us-ky/krs-77.185","jurisdiction":"us-ky","citation":"KRS 77.185","heading":"Public hearing to be held before enactment of orders, rules, or regulations --","body":"Adoption of procedural rules for the promulgation of regulations.\n(1) The air pollution control board shall not enact any order, rule, or regulation until it\nfirst holds a p ublic hearing thereon. It shall give notice of the public hearing by\npublication pursuant to KRS Chapter 424.\n(2) The air pollution control board shall, by regulation, adopt procedural rules for the\npromulgation of regulations. These rules shall provide th e public with a fair and\nreasonable opportunity for review of and comment on all proposed actions on\nregulations and shall ensure that the board provides full consideration to all written\nand oral comments prior to promulgating final regulations. The rules  shall, at a\nminimum, provide the public with:\n(a) At least thirty (30) days' notice prior to a public hearing on proposed actions\non regulations;\n(b) Copies of the proposed actions at the time of the notice;\n(c) A written response to all comments submitted on the proposed actions;\n(d) A written statement explaining the basis for any substantive amendments\nmade to a proposed action on regulations after its initial proposal; and\n(e) An assessment of the regulatory impact on the regulated community and the\npublic of each proposed action on regulations. The regulatory impact\nassessment shall include the estimated costs and savings associated with the\naction, the feasibility of all alternatives considered, and a comparison with any\nminimum or uniform standards u nder the Clean Air Act of 1963 as amended\nby the Clean Air Act Amendments of 1990 or any other federal requirement.\nThe board may rely on reasonably available information in assessing the\nregulatory impact of its regulatory actions. The regulatory impact a ssessment\nrequired by this subsection need not be developed when the proposed\nregulatory action is substantively identical to federal standards or\nrequirements.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24637","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"6d54ca29efa3c7118da449dd00ec57078bc7f7514f0a0b4c76eb69c47ffcbca8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.180","next":"us-ky/krs-77.190"},"notice":"GroundRules: Original legal text.
