{"data":{"id":"us-ky/krs-77.205","jurisdiction":"us-ky","citation":"KRS 77.205","heading":"Annual emission fees -- Permit fees.","body":"(1) The air pollution control board may provide by regulation a schedule of annual\nemission fees to cover all reasonable direct and indirect costs required to maintain\nauthorization to develop and administer the district's permit program requirements\nunder Title V of the Federal Clean Air Act of 1963 as amended by the Clean Air\nAct Amendments of 1990. Every person subject to a Title V permit shall pay the fee\nrequired by that schedule. Except as otherwise required under this section, the\ndistrict's per-ton emission fee shall be computed as follows: the approved budget for\nthe district's Title V permit program plus any deficit or minus any surplus from the\nprevious fiscal year divided by the actual emissions of regulated pollutants in the\nprevious year. The distr ict shall exclude from the emission fee calculation the\namount of a source's actual emissions of each regulated pollutant that the source\nemits in excess of four thousand (4,000) tons per year. Carbon monoxide shall not\nbe considered a regulated pollutant for purposes of assessing fees pursuant to this\nsubsection. All emission fees assessed by the district shall be expended to develop\nand implement the Title V permit program. Emission fees shall be deposited in an\ninterest-bearing account with earned interest to be deposited in the account.\n(2) The air pollution control board may provide by regulation a schedule of permit fees\nto cover all reasonable direct and indirect costs required to develop and administer\nthe district's non-Title V program.\n(3) Funds unexpended at the end of the fiscal year shall not lapse but shall be carried\nforward for future use as provided for in this section.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24642","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:37Z","sha256":"cc746719ab3c8bbfd0feaa6e748b2e49437d0642e54a79d52c68b29857bc0e93","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.200","next":"us-ky/krs-77.210"},"notice":"GroundRules: Original legal text.
