{"data":{"id":"us-ky/krs-77.320","jurisdiction":"us-ky","citation":"KRS 77.320","heading":"Elimination of vehicle emissions testing program in county containing","body":"consolidated local government -- Determination of need for program.\n(1) If by December 1 following the approval of a consolidated local government, the\ncounty containing the adopted consolidated local government has been notified by\nfederal authorities of the attainment of the county of the air quality standards\nestablished by the Federal Environmental Protection Agency for ozone, carbon\nmonoxide, and nitrogen dioxide, the air polluti on control district board in that\ncounty shall upon July 15, 2002, begin the necessary actions to eliminate any\nvehicle emissions testing program operated in the county by November 1, 2003. The\nair pollution control district board shall not enter into or r enew any contracts with\nany vendors for the operation of a vehicle emissions testing program which would\nextend beyond this date.\n(2) If a consolidated local government should be notified at a date beyond November 1,\n2003, of the county's nonattainment of the air quality standards established by the\nFederal Environmental Protection Agency for ozone, carbon monoxide, and\nnitrogen dioxide, notwithstanding the provisions of KRS 77.115, 224.20 -130, or\n224.20-760 to the contrary, the consolidated local governmen t shall determine the\nneed for the reestablishment, administration, operation, and the role, if any, of an air\npollution control district if a vehicle emissions testing program is re -created by the\nconsolidated local government in accordance with KRS 224.2 0-710 to 224.20-765.\nNothing in KRS Chapters 77 and 224 shall preclude a consolidated local\ngovernment from utilizing other methods and procedures for reaching attainment of\nthe air quality standards established by the Federal Environmental Protection\nAgency for ozone, carbon monoxide, and nitrogen dioxide.","path":["KRS Chapter 77"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24665","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:38Z","sha256":"62d9c1a6cdd1c64c4062a99cd814a863aca5463d408f2e80aa92a8755583ea5b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-77.315","next":"us-ky/krs-77.325"},"notice":"GroundRules: Original legal text.
