{"data":{"id":"us-ky/krs-77.990","jurisdiction":"us-ky","citation":"KRS 77.990","heading":"Penalties.","body":"(1) A person who violates any provision of this chapter shall be liable for the\nassessment by the district of a civil penalty not to exceed ten thousand dollars\n($10,000). Every day or any portion thereof during which the violation occurs or\ncontinues shall co nstitute a separate offense. If the violation is not settled by the\npayment of an assessment to the district, the district may proceed by a civil or\ncriminal action with the penalties provided in subsections (2), (3), and (4) of this\nsection. After a civil  or criminal action reaches final adjudication in court, the\ndistrict shall not assess a further civil penalty for the violation.\n(2) In a civil action, a person who violates any of the provisions of this chapter shall be\nliable for a civil penalty not to exceed ten thousand dollars ($10,000). Every day or\nany portion thereof during which the violation occurs or continues shall constitute a\nseparate offense.\n(3)  In a criminal action, any person who violates any provision of this chapter shall be\npunished by a fine not to exceed ten thousand dollars ($10,000) or by imprisonment\nfor a term of less than ninety (90) days. Every day or any portion thereof during\nwhich the violation occurs or continues shall constitute a separate offense.\n(4) Any person who knowi ngly violates any provision of this chapter, or who\nknowingly provides false information in any document filed or required to be\nmaintained under this chapter, or who knowingly renders inaccurate any monitoring\ndevice or method shall upon conviction be pun ished by a fine not to exceed ten\nthousand dollars ($10,000), or by imprisonment for a term of not less than one (1)\nyear and not more than five (5) years, or by both fine and imprisonment, for each\nseparate violation.
