{"data":{"id":"us-ky/krs-78.428","jurisdiction":"us-ky","citation":"KRS 78.428","heading":"Police officers excluded from classified service.","body":"(1) The provisions of KRS 78.400, 78.405, and 78.425 shall not apply to the chief of\npolice, assistant chiefs, and any officers above the rank of captain of county police\nforces in counties having a population of 600,000 or more. Said officers shall be\nappointed by the county judge/executive and shall not be considered covered\nofficers, except as provided in subsection (2) of this section.\n(2) Any employee covered by the provisions of KRS 78.400 to 78.480 who shall accept\nan appointment and qualify as chief of police or assistant chief of police shall be\ndeemed to have received a leave of absence from the classified service for and\nduring the incumbency of any of said respective positions. Should any such chief or\nassistant chief of police cease to serve as such  there shall be restored to him the\nsame classification and rank which he held prior to said appointment. Any person\nnot covered by the provisions of KRS 78.400 to 78.480 when appointed to the\nposition of chief of police or assistant chief of police shall not be deemed to be part\nof the classified service and shall not be returned to any classification or rank in the\nclassified service when he ceases to serve in such capacity.","path":["KRS Chapter 78"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24712","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:38Z","sha256":"06bd85bf3c3245b639530aa3518530772b32cd703f0c9103c6529d0d63b8da3d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-78.425","next":"us-ky/krs-78.430"},"notice":"GroundRules: Original legal text.
