{"data":{"id":"us-ky/krs-78.450","jurisdiction":"us-ky","citation":"KRS 78.450","heading":"Disciplinary action by board.","body":"(1) The board shall also have the right to remove, reduce, suspend, lay -off, fine or\ndiscipline any officer or employee covered by the provisions hereof on written\ncharges of misconduct preferred on its own initiative or the initiative of any citizen,\nbut only after reasonable notice to the accused and after a complete public hearing\nat which the officer or employee accused shall have the right to be present and\nrepresented by counsel and confronted by all of the witnesses preferring the charges\nagainst him. Every such employee or officer shall be given the right within ten (10)\ndays after charges are initiated by the board or a private citizen and before the\npublic hearing prescribed herein, to file written answer to the charges preferred\nagainst him.\n(2) After full public hearing by the board, the board may retire in executive session to\ndiscuss the evidence introduced at the hearing and to make its determination and\nconclusion. In no case shall the board in executive session receive any further\nevidence or com munication from any source whatsoever prior to reaching its\ndetermination and conclusion.\n(3) Before the board shall remove, reduce, suspend, lay -off, fine or discipline any\nofficer or employee covered by the provisions hereof, the charges against said\nofficer must be presented to the officer in writing and shall be specific as to the\nnature of the charge or charges, giving specific, detailed information so as to allow\nsaid officer to be able to properly defend himself.","path":["KRS Chapter 78"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24717","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:38Z","sha256":"859c9324c4fa41f710df75ab6f8cc92e62686877b6cdc7b03179d6869f97b531","source_id":"us-ky","stale":false,"prev":"us-ky/krs-78.445","next":"us-ky/krs-78.455"},"notice":"GroundRules: Original legal text.
