{"data":{"id":"us-ky/krs-78.625","jurisdiction":"us-ky","citation":"KRS 78.625","heading":"Information furnished by  employer  -- Filing of contributions,","body":"reimbursements,  and  reports -- Penalties for delinquency -- Audit of\nemployer.\n(1) Except as provided by subsection (6) of this section, the employer shall\nprepare the reporting records necessary for the system to administer the\nprovisions of KRS  78.510 to 78.852 and, from time to time, shall furnish the\ninformation the system may  require in the discharge of its duties. Upon\nemployment  of an employee, the employer shall inform him or her of his or her\nduties and  obligations in connection with the system as a condition of\nemployment.\n(2) The  agency reporting official of the county shall file the following at the\nretirement office on or before the tenth day of the month following the period\nbeing reported:\n(a) The  employee and employer contributions required under KRS  78.610\nand 78.635;\n(b) The  employer contributions and  reimbursements for retiree health\ninsurance premiums required under KRS 78.5540; and\n(c) A record of all contributions to the system on the forms prescribed by the\nsystems.\n(3) (a) If the agency reporting official fails to file at the retirement office all\ncontributions and reports on or before the tenth day of the month following\nthe period being reported, interest on the delinquent contributions at the\nactuarial rate adopted by the board compounded  annually, but not less\nthan one thousand dollars ($1,000), may be added to the amount due the\nsystem.\n(b) Delinquent contributions, with interest at the rate adopted by the board\ncompounded  annually, or penalties may  be recovered by action in the\nFranklin Circuit Court against the county liable or may, at the request of\nthe board, be deducted from any other moneys payable to the county by\nany department or agency of the state.\n(4) If an agency is delinquent in the payment of contributions due in accordance\nwith any of the provisions of KRS  78.510 to 78.852, refunds and retirement\nallowance payments to members  of this agency may be suspended until the\ndelinquent contributions, with interest at the rate adopted by the board\ncompounded  annually, or penalties have been paid to the system.\n(5) The  system may  at any time conduct an audit of the employer in order to\ndetermine if the employer is complying with the provisions of KRS  78.510 to\n78.852. The  system shall have access to and  may  examine  all books,\naccounts, reports, correspondence files, and records of any employer. Every\nemployer, employee, or agency reporting official of a county, as defined in KRS\n78.510(3), having records in its possession or under its control, shall permit\naccess to and examination of the records upon the request of the system.\n(6) Employers shall not be required to report any information or pay employer\ncontributions on any individual serving as a volunteer who  is receiving\ncompensation from the employer equal to or less than a nominal fee as defined\nby  KRS  61.510 and 78.510 if the compensation paid to the volunteer is\nexcluded from the definition of creditable compensation as provided by KRS\n61.510(13) or 78.510(13).","path":["KRS Chapter 78"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52284","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:39Z","sha256":"a82ac907987a72a6e01233976bbc7eecee62d54626ee9332aedb9f55c12f410a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-78.620","next":"us-ky/krs-78.630"},"notice":"GroundRules: Original legal text.
