{"data":{"id":"us-ky/krs-7a.276","jurisdiction":"us-ky","citation":"KRS 7A.276","heading":"Board membership -- Reimbursement for expenses.","body":"(1) The board shall be composed of the following members:\n(a) Ten (10) legislative members, as follows:\n1. Four (4) members of the House of Representatives appointed by the\nSpeaker of the House of Representatives, each of whom shall serve\nwhile a member of the  House for the term for which he or she has been\nelected, one (1) of whom shall be the chair or vice chair of the House\nStanding Committee on Health Services, and one (1) of whom shall be\nthe chair or vice chair of the House Standing Committee on Families\nand Children;\n2. One (1) member of the House of Representatives appointed by the\nMinority Floor Leader of the House of Representatives, who shall serve\nwhile a member of the House for the term for which he or she has been\nelected;\n3. Four (4) members of th e Senate appointed by the President of the\nSenate, each of whom shall serve a term of two (2) years, one (1) of\nwhom shall be the chair or vice chair of the Senate Standing Committee\non Health Services, and one (1) of whom shall be the chair or vice chair\nof the Senate Standing Committee on Families and Children; and\n4. One (1) member of the Senate appointed by the Minority Floor Leader\nof the Senate, who shall serve a term of two (2) years;\n(b) Eleven (11) nonlegislative, nonvoting members, as follows:\n1. The commissioner of the department or his or her designee;\n2. The chief medical officer of the Commonwealth or his or her designee;\n3. The chair of the Advisory Council for Medical Assistance established in\nKRS 205.540 or his or her designee;\n4. The state budget director or his or her designee;\n5. The Auditor of Public Accounts or his or her designee;\n6. The executive director of the Kent ucky Association of Health Plans, or\nits successor organization, or his or her designee;\n7. The director of the Center of Excellence in Rural Health established in\nKRS 164.937 or his or her designee;\n8. Two (2) members appointed by the Speaker of the House  of\nRepresentatives, of which:\na. One (1) shall have significant Medicaid -specific experience in\nhealthcare administration, financing, policy, or research; and\nb. One (1) shall be a licensed healthcare provider who is a\nparticipating Medicaid provider and who serves on one (1) of the\ntechnical advisory committees to the Advisory Council for\nMedical Assistance established in KRS 205.590; and\n9. Two (2) members appointed by the President of the Senate, of which:\na. One (1) shall have significant Medicaid -specific experience in\nhealthcare administration, financing, policy, or research; and\nb. One (1) shall be a licensed healthcare provider who is a\nparticipating Medicaid provider and who serves on one (1) of the\ntechnical advisory committees to the Advisory Cou ncil for\nMedical Assistance established in KRS 205.590; and\n(c) Two (2) nonvoting ex officio members, as follows:\n1. The chair of the House Standing Committee on Appropriations and\nRevenue; and\n2. The chair of the Senate Standing Committee on Appropriation s and\nRevenue.\n(2) (a) Of the members appointed pursuant to subsection (1)(a)1. of this section, the\nSpeaker of the House of Representatives shall designate one (1) as co -chair of\nthe board.\n(b) Of the members appointed pursuant to subsection(1)(a)3. of th is section, the\nPresident of the Senate shall designate one (1) as co-chair of the board.\n(c) In order to be eligible for appointment under subsection (1)(b)8. and 9. of this\nsection, an individual shall not:\n1. Be a member of the General Assembly;\n2. Be employed by a state agency of the Commonwealth of Kentucky; or\n3. Receive contractual compensation for services rendered to a state\nagency of the Commonwealth of Kentucky that would conflict with his\nor her service on the board.\n(d) For the purpose of appo inting members described in subsection (1)(b)8.a. and\n9.a. of this section, \"significant Medicaid -specific experience in healthcare\nadministration, financing, policy, or research\" means:\n1. Experience in administering the Kentucky Medical Assistance Program;\n2. A hospital administrator with relevant experience in Medicaid billing or\nregulatory compliance;\n3. An attorney licensed to practice law in the Commonwealth of Kentucky\nwith relevant experience in healthcare law;\n4. A consumer or patient advocate with relevant experience in the area of\nMedicaid policy; or\n5. A current or former university professor whose primary area of\nemphasis is healthcare economics or financing, health equity, healthcare\ndisparities, or Medicaid policy.\n(e) Individuals appointed to the board under subsection (1)(b)8. and 9. of this\nsection shall:\n1. Serve for a term of two (2) years; and\n2. Not serve more than one (1) consecutive term after which time he or she\nmay not be reappointed to the board f or a period of at least two (2)\nyears.\n(f) If an individual appointed to the board pursuant to subsection (1)(b)8.b. or\n9.b. of this section ceases to participate in the Medicaid program or ceases to\nserve on a technical advisory committee to the Advisory Council for Medical\nAssistance established in KRS 205.590, he or she may continue to serve on\nthe board until his or her replacement has been appointed.\n(3) (a) Any vacancy which may occur in the membership of the board shall be filled\nin the same manner as the original appointment.\n(b) A member of the board whose term has expired may continue to serve until\nsuch time as his or her replacement has been appointed.\n(4) Members of the board shall be entitled to reimbursement for expenses incurred in\nthe performance of their duties on the board.","path":["KRS Chapter 7A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55976","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:27Z","sha256":"0e8ed4c9a6029551656a15dee91a118a0e55739bd65d0a84663330efba1d1735","source_id":"us-ky","stale":false,"prev":"us-ky/krs-7a.273","next":"us-ky/krs-7a.279"},"notice":"GroundRules: Original legal text.
