{"data":{"id":"us-ky/krs-80.010","jurisdiction":"us-ky","citation":"KRS 80.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Housing\" means a building or buildings containing rooms to be provided as living\nquarters, together with shops, stores, garages, laundries, doctors' and dentists'\noffices, and other facil ities and appurtenances deemed reasonably necessary by the\nhousing authority to the successful and economical operation of the project. It also\nmeans any work or undertaking of a housing authority or of the federal government\nto:\n(a) Demolish, clear, or re move a building or buildings from any slum area,\nincluding the adaptation of such area to recreational, community, or other\npublic purposes;\n(b) Provide decent, safe, and sanitary living accommodations for persons who\nlack the amount of income that is nece ssary, as determined by the authority\nundertaking the project, to enable them, without financial assistance, to obtain\nsuch accommodations; such work or undertaking may include buildings, land\nequipment, facilities, and other real or personal property for necessary,\nconvenient, or desirable appurtenances, streets, sewers, water service, parks,\nsite preparation, gardening, administrative, community, health, recreational,\nwelfare, or other purposes;\n(c) Accomplish a combination of the foregoing and any purpos es and objectives\npermitted of public housing authorities authorized by the United States\nHousing Act of 1937, 42 U.S.C., sec. 1401, as amended from time to time;\n(2) \"Housing authority\" or \"authority\" means any housing authority created pursuant to\nthis chapter;\n(3) \"Public body\" means any city, county, commission, district, authority, or other\npublic body or political subdivision of the Commonwealth;\n(4) \"Federal government\" includes the United States of America, the United States\nhousing authority and it s successor agencies, and any other agency or\ninstrumentality of the United States of America;\n(5) \"Bonds\" means any bonds, notes, interim certificates, debentures, or other\nobligations;\n(6) \"Clerk\" means the clerk of the city or the clerk of the county, a s the case may be, or\nthe officer charged with the duties customarily imposed on such clerk;\n(7) \"Governing body\" means, in the case of a city, the city council, the commission,\nboard of commissioners, board of aldermen, or other legislative body of the ci ty,\nand in the case of a county, the fiscal court;\n(8) \"Mayor\" means the mayor of the city or the officer thereof charged with the duties\ncustomarily imposed on the mayor or executive head of the city;\n(9) \"Obligee of the authority\" or \"obligee\" shall incl ude any bondholder, trustee or\ntrustees for any bondholders, or lessor demising to the authority property used in\nconnection with a housing project, or any assignee or assignees of such lessor's\ninterest or any part thereof, and the federal government when  it is a party to any\ncontract with the authority;\n(10) \"Persons of low income\" means persons or families who lack the amount of income\nwhich is necessary, as determined by the housing authority undertaking the housing\ndevelopment, to enable them, without financial assistance, to live in decent, safe,\nand sanitary dwellings, without overcrowding;\n(11) \"Real property\" includes all lands, including improvements and fixtures thereon,\nand property of any nature appurtenant thereto, or used in connection therewith, and\nevery estate, interest and right, legal or equit able, therein, including terms for years\nand liens by way of judgment, mortgage, or otherwise and the indebtedness secured\nby such liens;\n(12) \"Slum\" means any area where dwellings predominate which, by reason of\ndilapidation, overcrowding, lack of ventila tion, light, or sanitary facilities, or any\ncombination of these factors are detrimental to safety, health and morals; and\n(13) \"Low income\" and \"moderate income\" shall have those meanings as from time to\ntime are promulgated by federal and state governmen tal agencies providing funding\nfor the then applicable housing program.","path":["KRS Chapter 80"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48680","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:40Z","sha256":"0a7faffdfbb328c0cc70e5408977ae590486f6856c728d144f381293bd1d524b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-8.090","next":"us-ky/krs-80.020"},"notice":"GroundRules: Original legal text.
