{"data":{"id":"us-ky/krs-80.262","jurisdiction":"us-ky","citation":"KRS 80.262","heading":"Formation of city-county housing authority.","body":"(1) If the governing body of a city and of a contiguous county by resolution declare that\nthere is a need for one (1) housing authority to be created for the city and county to\nexercise in that city and county the powers and functions prescribed for a city -\ncounty housing authority, a public body corporate and politic to be known as a\n\"city-county housing authority\" (with such corporate name as it selects) shall\nthereupon exist for all of that city and county and exercise its powers and other\nfunctions within it s area of operation (as herein defined) including the power to\nundertake projects therein.\n(2) Provided, however, if there is an existing municipal or county housing commission,\nsuch resolution of the governing bodies of the city and contiguous county sha ll not\ntake effect unless preceded by a request to do so in a resolution of the existing\nmunicipal or county housing commission or commissions. Such resolution of the\ngoverning body of a city and of a contiguous county shall also provide for the\nabolishment of any municipal and contiguous county housing commissions existing\nin the city and county adopting the resolution, on a day certain, on which day the\nauthority, responsibilities, personnel and property, both real and personal, of said\nmunicipal and cont iguous county housing commissions are then and there\ntransferred to the newly created city -county housing authority, and the present\ncommissioners of the existing municipal and contiguous county housing\ncommissions shall continue to serve out their appoint ed terms as members of the\nnewly created city -county housing authority.
