{"data":{"id":"us-ky/krs-81.028","jurisdiction":"us-ky","citation":"KRS 81.028","heading":"Effect of reclassification of city in county containing consolidated local","body":"government as city of second class on personnel and retirement systems and\npolice and fire protection services.\n(1) Any city located in a county containing a consolidated loca l government which was\nreclassified as a city of the second class after March 16, 2000, but prior to January\n1, 2015, under a classification system in effect before January 1, 2015, shall be\nexempt from the provisions of KRS 90.300 to 90.400, 95.430 to 95. 500, and 95.851\nto 95.991 relating to the organization and structure of civil service systems, police\ndepartments, fire departments, and pension systems in cities.\n(2) In lieu of the requirements of these statutes, any city reclassified under the\nconditions set out in subsection (1) of this section shall ensure that police and fire\nprotection services are provided for the citizens of the city in the same manner and\nat least at the same level of service as was being provided prior to the\nreclassification.\n(3) Nothing in this section shall prevent a city from restructuring or creating a new civil\nservice system, police department, or fire department after a reclassification under\nthe conditions set out in subsection (1) of this section. Any city that restructu res or\ncreates a new civil service system, police department, or fire department may adopt\nany of the provisions of KRS 90.300 to 90.400, 95.430 to 95.500, and 95.851 to\n95.991 relating to the organization and structure of civil service systems, police\ndepartments, fire departments, and pension systems.\n(4) If fire protection service was being provided by a fire protection district in any city\nthat was reclassified under the conditions set out in subsection (1) of this section,\nthe reclassification shall in no way affect the operations of the fire protection district\nand the services it provides. If at any time after a city is reclassified, the fire\nprotection district ceases to exist or fails to adequately provide for the fire\nprotection needs of the city, the city shall have the right to create its own fire\ndepartment or secure some other means for the provision of adequate fire protection\nservices.","path":["KRS Chapter 81"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43589","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:41Z","sha256":"23e62438e8688919705e986721b15a183793bdbcde1b634192fa38434be5bc6c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81.026","next":"us-ky/krs-81.030"},"notice":"GroundRules: Original legal text.
