{"data":{"id":"us-ky/krs-81.094","jurisdiction":"us-ky","citation":"KRS 81.094","heading":"Condition for dissolution -- Procedure.","body":"(1) If any city fails for one (1) year to maintain a city government by both the election\nor appointment of officers and the levying and collection of necessary taxes, it shall\nbe dissolved by judgment of the Circuit Court on petition filed by a bona fide\nresident of the city.\n(2) A city, except for a city which has long -term debt, or any debt in excess of the\nassets of the city, shall be dissolved by the following procedure:\n(a) Any qualified voter of the city may file with the mayor of the city a petition\nseeking a referendum on the question whether the city shall be dissolved. All\npapers of the petition shall be uniform in size and style and shall be assembled\nas one (1) instrument for filing. Each signature shall be executed in ink or\nindelible pencil and sh all be followed by the address of the person signing.\nWhen it is filed, each sheet of a petition shall have an affidavit executed by\nthe circulator stating that he personally circulated the sheet; the number of\nsignatures thereon; that all signatures were affixed in his presence; that he\nbelieves them to be the genuine signatures of registered voters in the city; and\nthat each signer had an opportunity before signing to read the full text of the\npetition. Petitions shall contain or have attached throughout their circulation\nthe full text of the following proposal: \"We the undersigned registered voters\nof the City of ______ hereby petition the mayor for an election on the question\nwhether the city should be dissolved.\";\n(b) If such a petition signed by regist ered voters of the city equal in number to at\nleast twenty percent (20%) of the total number of votes cast in the city in the\nlast presidential election is presented to the mayor, the mayor of the city shall\ndeliver a certified copy of the petition to the county clerk of the county in\nwhich the greater part of the city is located within ten (10) working days after\nit is received by the mayor. The county clerk shall have printed on the ballot\nprovided for use in each precinct embraced in whole or in part wit hin the city\nthe question: \"Are you in favor of dissolving the City of ______?\" The mayor\nshall file the petition with the county clerk within ten (10) working days after\nhe receives it. The election shall be held at the next general election if the\npetition is filed with the county clerk and certified by the county clerk as\nsufficient not later than the second Tuesday in August preceding the general\nelection; and\n(c) If a majority of those voting in the election favor the dissolution of the city,\nthe city shall cease to be an incorporated city within thirty (30) days of the\ncertification of the election results. The terms of all elected and appointed\nofficers shall terminate at such time and all assets of the city shall become the\nproperty of the fiscal cou rt of the county in which the city is located. The\ncounty clerk shall note the dissolution in his records and notify the Secretary\nof State in writing of the dissolution.\n(3) Each petition for dissolution filed with the Circuit Court pursuant to subsection  (1)\nof this section shall be filed in the Circuit Court of the county in which the greater\npart of the city is located and shall set out the name and class of the city, a metes\nand bounds description of its boundaries, the reasons why dissolution is sough t and\nother facts relevant to the petition.","path":["KRS Chapter 81"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24957","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:41Z","sha256":"b491cd4e7749f0f0ef63e5fcff6bb2e3cb51f37abcb8789e01a9e8ffc688b9e5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81.090","next":"us-ky/krs-81.096"},"notice":"GroundRules: Original legal text.
