{"data":{"id":"us-ky/krs-81.330","jurisdiction":"us-ky","citation":"KRS 81.330","heading":"When plan to take effect -- Exclusion of city from boundaries of new city --","body":"Result -- Liability of city of first class.\n(1) If more than half of the votes cast within the city of the first class and more than\nhalf of the votes cast in the affected are a outside of the city of the first class are in\nfavor of the plan, then it shall be effected and the boundaries of the city of the first\nclass shall thirty (30) days after the certification of the election be extended so as to\ninclude the area described in  accordance with KRS 81.310, including any city of a\nlesser class within such area, except,\n(2) If in any city other than of the first class within the area affected (except cities\nincorporated within twelve (12) months of the submission of the question o n the\nplan to the voters), more than half of the votes cast are opposed to the plan, then\nsuch city shall be excluded from the new boundaries of the city of the first class.\nThe total votes cast in any such city rejecting the plan shall be deducted from th e\ntotal votes cast on the question so that the votes cast in such city shall have no effect\nupon the acceptance or rejection of the plan as a whole.\n(3) If the plan is approved, thereafter, neither the county government nor any of its\nagencies or joint agencies shall be required to render any services within a rejecting\ncity that it does not render within a city of the first class in accordance with the plan.\nHowever, the fiscal court may determine that the rendition of any governmental\nservice within a rejecting city is necessary for the public health, safety or welfare in\nwhich event the rejecting city may be required to pay to the county the costs of such\nservices rendered.\n(4) The city of the first class shall be bound for all the debts and liabilities  and shall be\nthe owner of all corporate property, franchises and rights of any city included within\nits boundaries extended as hereinabove provided and becoming a part thereof; thirty\n(30) days after the certification of the approval of the plan by the vo ters any such\ncity shall cease to exist.","path":["KRS Chapter 81"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=24988","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:42Z","sha256":"735afba0f82f5952af4ca13a6b324a9b22ce82610c55a204e7f985b9233d54fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81.320","next":"us-ky/krs-81.340"},"notice":"GroundRules: Original legal text.
