{"data":{"id":"us-ky/krs-81a.050","jurisdiction":"us-ky","citation":"KRS 81A.050","heading":"Proceedings to incorporate.","body":"Any city of the first class which proposes to annex territory pursuant to KRS 81A.010\nshall, prior to the enactment of the first ordinance, hold public hearings as provided in\nKRS 81A.060 and prepare a report setting forth the plans for the extension of se rvices to\nthe area proposed to be annexed.  The report shall include:\n(1) A map of the city and adjacent territory to show the following information:\n(a) The present and proposed boundaries of the city;\n(b) The present streets, major trunk water mains, sew er interceptors and outfalls\nas well as other utility lines;\n(c) The present areas receiving, or able to receive, major city services, and the\nproposed extension of such services to other areas;\n(d) The prevailing general land use patterns existing in the area to be annexed;\nand\n(e) If zoning has been adopted by the annexing city, a map showing the zoning\nthat will be effective for the annexed area;\n(2) A statement showing that the area to be annexed meets the requirements of KRS\n81A.010;\n(3) A statement se tting forth the plans of the city for extending to the area to be\nannexed each major city service owned by the city or subsidized through city tax\nrevenues and performed within the city at the time of annexation.  Such statement\nshall:\n(a) Provide for extending police and fire protection, garbage collection, and street\nmaintenance services to the area to be annexed on the date of annexation, on\nsubstantially the same basis and in the same manner as such services are\nprovided within the boundaries of the city prior to annexation;\n(b) Provide for extension, into the area to be annexed, of streets and of major\ntrunk water mains, sewer outfall lines, and lines for such utility services as the\ncity provides to existing city residents and legally may provide in th e annexed\narea, so that when such streets and utility lines are constructed, property\nowners in the area to be annexed will be able to secure the services, according\nto the policies in effect in the city for extending the services to individual lots\nor sub divisions; and shall name the government proposed to be responsible\nunder the plans for any streets or form a boundary of the area to be annexed;\n(c) Set forth a proposed timetable for the extension of, and if necessary, the\nconstruction for each major city service;\n(d) Set forth a projected estimation of tax rates pursuant to KRS 81A.070 to be\nlevied by the city upon the area to be annexed and affected residents of that\narea for each year until such time that all major city services have been\nprovided; and\n(e) Set forth the method under which the city plans to finance extension of\nservices into the area to be annexed.","path":["KRS Chapter 81A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25003","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:42Z","sha256":"47b2c9ae00aa582c97c4645289672cf0dd72eee8c8b64bf1635af6f8604eada1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81a.040","next":"us-ky/krs-81a.060"},"notice":"GroundRules: Original legal text.
