{"data":{"id":"us-ky/krs-81a.412","jurisdiction":"us-ky","citation":"KRS 81A.412","heading":"Annexation permitted when each of the owners gives prior consent --","body":"Notice to county fiscal court.\n(1) A city may annex any area which meets the requirements of KRS 81A.410, if each\nof the owners of record of the land to be annexed gives prio r consent in writing to\nthe annexation. In this event, the city shall not be required to enact the notification\nordinance required by KRS 81A.420(1) or to comply with the notice requirements\nof KRS 81A.425, and it shall not be required to wait the sixty (6 0) day period\nprovided for in KRS 81A.420(2) prior to enacting a final ordinance annexing the\narea. When a city has obtained the prior written consent of each owner of record of\nthe land to be annexed, the city may enact a single ordinance finally annexing  the\nland described in the ordinance. If the city has elected to establish the zoning for the\nnew territory pursuant to KRS 100.209 prior to the completion of annexation under\nthis section, the ordinance annexing the territory shall include a map showing t he\nzoning. Upon the enactment of this ordinance, the territory shall become a part of\nthe city.\n(2) When a city located in a county subject to the crediting provisions set forth in KRS\n68.197 proposes to annex territory, it shall provide written notice to the fiscal court\nof the county in which the territory is located regarding the proposed annexation\nthat includes a map and description of the territory to be annexed at least forty -five\n(45) days prior to the enactment of the ordinance finally annexing the  territory into\nthe city.","path":["KRS Chapter 81A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55340","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:42Z","sha256":"410916e1d7bb67f7ddcb4c323ded2797e382b0c1742ab2e7eb2181f9580fc3d6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81a.410","next":"us-ky/krs-81a.415"},"notice":"GroundRules: Original legal text.
