{"data":{"id":"us-ky/krs-81a.415","jurisdiction":"us-ky","citation":"KRS 81A.415","heading":"Annexation by a city contained within two counties of an area in an","body":"additional county.\n(1) If a city is wholly contained within two (2) counties and that city intends to annex\nterritory in an additional county, then it may proceed if:\n(a) The territory proposed to be annexed:\n1. Is adjacent or contiguous to the city's boundaries at the time the\nannexation proceeding is begun;\n2. Which by reason of population density, commercial, industrial,\ninstitutional, or governmental use of land, or subdiv ision of land, is\nurban in character or suitable for development for urban purposes\nwithout unreasonable delay;\n3. Is not within the boundary of another incorporated city; and\n4. Contains infrastructure owned by the city or any agency, political\nsubdivision, department, or instrumentality of the city, including\ngoverning bodies of municipal utilities operating under KRS Chapter 96;\nhowever, the territory to be annexed shall not include any territory that\ndoes not contain infrastructure as set out in this subparagraph; and\n(b) Each of the owners of record of the territory proposed to be annexed gives\nprior consent in writing to the annexation and the annexation is proceeding\nunder the provisions of KRS 81A.412.\n(2) (a) At least thirty (30) days prior to the a doption of the annexation ordinance\nunder KRS 81A.412, the city shall provide notice of the proposed annexation\nto the fiscal court of the county containing the territory to be annexed. The\nfailure of the city to notify the fiscal court of the annexation a s set out in this\nsubsection shall serve to void the ordinance annexing the territory contained\nin that county.\n(b) The notice set out in paragraph (a) of this subsection shall:\n1. Contain, at a minimum:\na. A description of the territory to be annexed;\nb. The date in which the annexation shall take effect, that date being\nthe passage of the ordinance annexing the territory; and\nc. A certification by the mayor of the city proposing the annexation\nthat the city shall comply with the applicable requirements of  this\nchapter; and\n2.
