{"data":{"id":"us-ky/krs-81a.510","jurisdiction":"us-ky","citation":"KRS 81A.510","heading":"Annexation of unincorporated territory in which industrial plants are","body":"located -- Public policy stated -- Prerequisites -- Protest and hearing.\n(1) The General Assembly, recognizing that the general welfare and prosperity of the\nCommonwealth of Kentuck y is very greatly dependent upon continued industrial\ndevelopment and expansion; and, further recognizing that reasonable assurances of\nfair treatment will greatly increase industrial development and expansion in\nKentucky, it hereby is declared to be the p ublic policy of the Commonwealth of\nKentucky to encourage the location of new industries and the expansion of existing\nindustries in Kentucky by prohibiting unfair and unreasonable annexation by\nmunicipal corporations of industries now or hereafter located  in unincorporated\nareas. However, it is not the intent of the General Assembly to prohibit, restrict or\nhamper normal expansion of municipal boundaries if such normal development and\nexpansion extends to and embraces such industrial properties.\n(2) No unincorporated territory in which is located an industrial plant or plants shall be\nannexed by any municipality unless such territory is embraced within a broad,\ncomprehensive plan of annexation. The territory to be annexed shall be contiguous\nto the boundary  line or lines of such municipality, and the territory or area to be\nannexed shall be both compact and contiguous. The number of registered voters\nduly qualified to vote in the territory proposed to be annexed shall equal or exceed\nfifty percent (50%) of t he average number of persons employed by industrial plants\nwithin such territory during the next preceding calendar year, the number of such\nregistered voters to be determined by taking the total of such voters from the last\nclosed registration books in the county clerk's office.\n(3) Nothing herein shall be construed as prohibiting any municipality from annexing\nany industrial plant or plants or its properties if the duly authorized representatives\nof such industrial plant or plants consent to or request such action.\n(4) Any person or persons within the area proposed to be annexed shall have the right\nto file a protest and to have the protest heard and determined as now provided by\nexisting statutes.","path":["KRS Chapter 81A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25021","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:42Z","sha256":"86cf0754a5c1800e1cec830c605af2b16b895b9edee1aaa33d64cd662dd0f82e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-81a.500","next":"us-ky/krs-81a.520"},"notice":"GroundRules: Original legal text.
