{"data":{"id":"us-ky/krs-82.105","jurisdiction":"us-ky","citation":"KRS 82.105","heading":"Definitions for KRS 82.105 to 82.180.","body":"As used in KRS 82.105 to 82.180, the following words and terms have the following\nrespective meanings unless it shall clearly appear from the context that another meaning\nis intended:\n(1) \"City\" means a city of any class;\n(2) \"Governing body\" means the legislative body of a city;\n(3) \"Governmental agency\" means the Commonwealth, the United States, or any\ndivision, department, agency or instrumentality of either of them, including\nagencies and instrumentalities in corporate form, whether created by legislati ve\nenactment or organized as nonprofit corporations under general corporation laws for\nthe purpose of serving as agencies or instrumentalities of either of them;\n(4) \"Governmental project\" means any building, structure, installation, activity,\nundertaking or program proposed by a governmental agency in furtherance of any\nlawful governmental or proprietary function of a governmental agency;\n(5) \"Contract of inducement\" means any contract, agreement, or offer and acceptance,\nwhereby a city agrees to provide a n inducement to a governmental agency, under\nauthority of KRS 82.105 to 82.180, either (i) to establish or locate in the city or its\nenvirons a governmental project which might, but for such inducement, be\nestablished elsewhere, or not at all; or (ii) to e stablish or locate upon one or more\nparticular sites deemed by the city, acting through its governing body, to be best\nsituated in the interests of future city planning and development, or otherwise in the\nbest interests of the public health, safety, welfa re or convenience of the citizens and\ninhabitants of the city and its environs, a governmental project otherwise chosen or\nunder consideration for establishment or location upon one or more other sites in or\nnear the same city;\n(6) \"Inducement\" or \"municip al inducement\" means appropriation of public funds\nderived from any source and not required by law to be applied, reserved or\nappropriated to some other purpose, issuance of bonds and application of bond and\napplication of bond proceeds, and provision of a ny lands, improvements or\nappurtenances authorized in KRS 82.105 to 82.180 to be acquired, constructed,\ninstalled or undertaken by a city as an inducement for a purpose authorized to be\naccomplished or promoted under the provisions of a contract of inducement;\n(7) \"Revenue bonds\" and \"general obligation bonds\" mean, respectively, the bonds\nwhich a city is authorized in KRS 82.105 to 82.180 to issue under such\ndesignations;\n(8) \"Bonds\" or \"bond proceeds,\" if unaccompanied by other designation, refer to eithe r\nrevenue bonds or general obligation bonds, or both of them, and the proceeds\nthereof, as the context may indicate.","path":["KRS Chapter 82"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:43Z","sha256":"0dcacbb84afea0696f38a6d819b0344ce662114fbcde021de71c601c10e18a28","source_id":"us-ky","stale":false,"prev":"us-ky/krs-82.096","next":"us-ky/krs-82.110"},"notice":"GroundRules: Original legal text.
