{"data":{"id":"us-ky/krs-83a.160","jurisdiction":"us-ky","citation":"KRS 83A.160","heading":"Change in form of government permitted by popular vote only.","body":"(1) Any city may become organized and governed under the mayor -council plan, the\ncommission plan or the city manager plan only by popular vote in accordance with\nKRS 83A.120.\n(2) If a majority of the votes cast are in favor of changing the organization and\ngovernment of the city, the corporate entity of the city shall remain the same as it\nwas before the change. All laws applicable to and governing cities and not\ninconsistent with the newly adopted plan shall continue to apply to and govern each\ncity that so c hanges its plan. All city ordinances, resolutions and orders in force in\nany such city and not inconsistent with the newly adopted plan shall continue in\nforce until amended or repealed in the manner provided in the new plan.\n(3) Upon the expiration of th e terms of the existing legislative body members, or if\nterms are staggered, when the terms of a sufficient number of members have\nexpired to achieve a correct number of members remaining, or upon election of a\nsufficient number of additional members at th e next regular election to achieve a\ncorrect number of members, the city shall be organized and governed under the\nnewly adopted plan as provided in this chapter and shall take action necessary to be\nin compliance with this chapter. In no event shall a cit y not be in compliance two\n(2) years after the adoption of the new plan by the voters.\n(4) Failure on the part of any ministerial officer to perform the duties required of him\nby this section shall not prevent the change of the plan of organization and\ngovernment of the city.\n(5) No city which changes the plan under which it is organized and governed under this\nsection shall again change the plan sooner than five (5) years from the effective date\nof the last change.\n(6) Any city with the largest populati on located in a county with a population equal to\nor greater than two hundred fifty thousand (250,000) based upon the most recent\nfederal decennial census may elect to become organized and governed under the\nmayor-alderman plan of government provided in KR S 83.410 to 83.660 by popular\nvote in accordance with KRS 83A.120.
