{"data":{"id":"us-ky/krs-83a.165","jurisdiction":"us-ky","citation":"KRS 83A.165","heading":"Election to fill unexpired term of city office.","body":"(1) A candidate running to fill the unexpired term of any city office shall file his or her\nnomination papers in accordance with the provisions of KRS 83A.045, 118.365,\n118.375, and 83A.047.\n(2) Vacancies in the office of mayor or city legislative body that ar e to be filled\ntemporarily by appointment shall be governed by the provisions of KRS 83A.040\nand Section 152 of the Kentucky Constitution.\n(3) Vacancies in the office of mayor or city legislative body that are to be filled by\npartisan election shall be governed by the following provisions:\n(a) Vacancies in candidacy shall be governed by KRS 118.105;\n(b) Nominations for unexpired terms shall be governed by KRS 118.115 and\nSection 152 of the Kentucky Constitution; and\n(c) Independent candidates filing to fill  a vacancy shall be governed by KRS\n118.375.\n(4) Vacancies in the office of mayor or city legislative body that are to be filled by\nnonpartisan election shall be governed by the following provisions:\n(a) If the vacancy occurs not less than one hundred sixt y (160) days before a May\nprimary, candidates to fill the vacancy shall be nominated at that primary in\nthe manner prescribed in KRS 83A.170;\n(b) If the vacancy occurs on or after the one hundred sixtieth day before a May\nprimary or at any time before the time prescribed in KRS 118.365 for filing\npetitions of nomination, the election to fill the unexpired term shall be held\nwithout a primary in the manner prescribed in Section 152 of the Kentucky\nConstitution. Petitions of nomination for candidates to fill the vacancy shall\nbe filed at the time and place prescribed in KRS 118.365;\n(c) If the vacancy occurs after the time prescribed in KRS 118.365 for filing\npetitions of nomination, but not less than three (3) months before the regular\nelection, petitions of nomination for candidates to fill the vacancy shall be\nfiled not later than the second Tuesday in August preceding the regular\nelection for the office sought; and\n(d) Vacancies in candidacy in any city that has eliminated the nonpartisan primary\nelection p ursuant to KRS 83A.045 shall be governed by the provisions of\nKRS 83A.045(2)(b)6.","path":["KRS Chapter 83A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49480","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:44Z","sha256":"89e200908486e412231d81b164f9d9fec99be6e53ca72506b5d3c30c404143b7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-83a.160","next":"us-ky/krs-83a.170"},"notice":"GroundRules: Original legal text.
