{"data":{"id":"us-ky/krs-90.110","jurisdiction":"us-ky","citation":"KRS 90.110","heading":"Definitions for KRS 90.110 to 90.230.","body":"The following terms, as used in KRS 90.110 to 90.230, shall have the following\nmeanings, unless the context clearly requires otherwise:\n(1) \"Emergency appointment\" means any appointment to any position subject to the\nprovisions of KRS 90.110 to 90.230, whi ch may be made only in the absence of an\nappropriate eligible list for the position and which may be made without\ncompetitive examination pending the establishment of an eligible list and which\nappointment shall not exceed the duration of the emergency and  in no case to\nexceed ninety (90) days in any one (1) fiscal year.\n(2) \"Probationary appointment\" means an appointment to any position subject to the\nprovisions of KRS 90.110 to 90.230, which shall be made in accordance with the\nprovisions of KRS 90.180 and which shall not be less than six (6) months nor more\nthan one (1) year in duration.\n(3) \"Regular appointment\" means an appointment to a position subject to the provisions\nof KRS 90.110 to 90.230 made after an employee has served a probationary period\nin a manner deemed satisfactory to the appointing authority.\n(4) \"Director\" means the personnel director, as provided for in KRS 90.140.\n(5) \"Position\" means every place of employment in the classified service hereunder\nincluding office.\n(6) \"Employee\" means any person in the classified service hereunder.\n(7) \"Classified service\" means all positions in cities of the first class within the\njurisdiction of the board, and within the purview of KRS 90.110 to 90.230.\n(8) \"Board\" means the civil service board created hereunder.\n(9) \"Appointing authority\" means the officer, board, commission, department, agency,\nperson or group of persons, having the power of appointment to and removal from\npositions in the classified service as provided for in KRS 90.110 to 90.230.\n(10) \"Competitive examination\" shall include consideration and rating of any or all of\nthe following qualifications of applicants: Education, training, experience, general\nadaptability, special aptitude, physical fitness, knowledge, skill, personality,\ncharacter, and such other qualifications as may be deemed necessary for the\nsatisfactory performance of the duties of the respective positions.\n(11) \"Eligible list\" means a list of names of persons who have been found qualified\nthrough suitable competitive exa minations for positions or classes of positions as\nprovided for in KRS 90.110 to 90.230.\n(12) \"Service ratings\" means the evaluation of the efficiency and general worth of\nemployees in positions subject to the provisions of KRS 90.110 to 90.230 as\ndetermined by the appointing authority.\n(13) \"Dismissal\" means the discharge of an employee by the appointing authority.\n(14) \"Lay-off\" means the separation of an employee from the classified service because\nof a reduction of force owing to decreased work or decreased funds in the\ndepartment, commission, board or agency in which the employee has been\nemployed.\n(15) \"Class\" or \"class of positions\" means a position or group of positions subject to the\nprovisions of KRS 90.110 to 90.230 sufficiently similar in duties, responsibilities\nand qualification requirements to be designated by the same title and placed within\nthe same salary range.\n(16) \"Reinstatement\" means the reappointment of a person who formerly held a position,\nsubject to the provisions of KRS 90.110 to 90.230, to such former position or to any\nother position in the same class.\n(17) \"Transfer\" means a change by an employ ee from one (1) position to another\nposition within the same class.\n(18) \"Promotion\" means a change from a position in a lower class to a position in a\nhigher class involving an increase in responsibility or a change in title.\n(19) \"Demotion\" means a chang e from a position in a higher class to a position in a\nlower class involving a decrease in responsibility or a change in title.\n(20) \"Suspension\" means the separation of an employee from the service for a temporary\nor fixed period of time, which separation  is inflicted upon the employee by his\nappointing authority, as a disciplinary measure under the rules established by the\nboard.\n(21) \"Public hearing\" means such as may be given after public notice of at least five (5)\ndays, so that any person or persons m ay have an opportunity to appear before the\nboard and be heard on the matter involved.","path":["KRS Chapter 90"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25424","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:47Z","sha256":"b9bd27bda6ab7823420ad9430b1fcfc6c47a42d86ec4bf67e41c5770e63a71f9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-90.100","next":"us-ky/krs-90.120"},"notice":"GroundRules: Original legal text.
