{"data":{"id":"us-ky/krs-90.170","jurisdiction":"us-ky","citation":"KRS 90.170","heading":"Eligible lists -- Period in force -- Removal of names -- Supplemental lists --","body":"Emergency appointments -- Public inspection of lists -- Reinstatement of\nnames.\n(1) Each eligible list shall remain in force until exhausted, or until replaced by a more\nrecently prepared list, but not beyond two (2) years from the date of its\nestablishment. The names of persons who have indicated in writing to the director\nthat they are unwilling to accept appointment, or request in writing that their names\nbe dropped from the list, or who have been certified for appointment three (3) times\nand not appointed, shall be dropped from the list.\n(2) If during the lifetime of a list it shall have dwindled to the point that three (3) or\nfewer names remain thereon, or if for other re ason the board deems it necessary for\nthe good of the service to prepare and establish a supplemental list, the board may\nin its discretion do so; in such event the original list shall be combined with the\nsupplemental list, and all names shall be placed o n the combined list according to\ngrade, without regard to priority in time of examination; provided, however, no\nname shall remain upon eligible lists for a period longer than two (2) years, at\nwhich time it shall be dropped from the list. The board, by ru le, may prescribe other\nreasons for removal of names from an eligible list and for written notice to those so\nremoved.\n(3) In the absence of any appropriate eligible list any position or office may be filled\ntemporarily by the appointing authority without examination for a period not to\nexceed ninety (90) days, during which time the board shall hold the necessary\nexamination for the filling of the place regularly, but persons may be temporarily\nemployed for emergency work without examination for the period of the\nemergency, in no event to exceed ninety (90) days in any one (1) fiscal year, such\nappointment to be an emergency appointment and the same shall not be renewed.\nNo person shall be appointed or employed under any title not appropriate to the\nduties to be performed. No person shall be transferred to or assigned to perform any\nduties of any position subject to competitive tests unless he shall have been\nappointed to the position from which transfer is made as a result of a competitive\ntest, equivalent t o that required for the position to be filled, or appointed as\notherwise herein provided under KRS 90.180 and 90.210.\n(4) Each list of eligibles, with the respective grades, shall be open to public inspection.\nAny person appointed from the eligible list an d laid-off for lack of work, or lack of\nappropriation, shall be placed at the head of the eligible list, and shall be eligible for\nreappointment for a period of eligibility as provided by the rules of the board.","path":["KRS Chapter 90"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25430","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:47Z","sha256":"8280ba3d916099ee4e3ff2c6162317a1944f37217be61ee53e095c2a45b2ba41","source_id":"us-ky","stale":false,"prev":"us-ky/krs-90.160","next":"us-ky/krs-90.180"},"notice":"GroundRules: Original legal text.
