{"data":{"id":"us-ky/krs-90.300","jurisdiction":"us-ky","citation":"KRS 90.300","heading":"Definitions for KRS 90.310 to 90.410 -- Application.","body":"(1) In KRS 90.310 to 90.410, unless the context requires otherwise:\n(a) \"Administrative or directorial position\" means the head of a department of\nmunicipal government;\n(b) \"Appointing authority\" means the officer, commission, board or body having\nthe power of  appointment or removal in any office, department, commission,\nboard or institution;\n(c) \"Civil service\" means the offices and positions of trust or employment in the\nservice of the city not specifically excluded by KRS 90.310 to 90.410 or by\nordinance of the city as provided in KRS 90.310;\n(d) \"Commission\" means the board of civil service commissioners as established\nunder KRS 90.310;\n(e) \"Dismissal\" means the discharge of an employee;\n(f) \"Employee\" means any person employed in the conduct of municipal af fairs,\nbut the term shall not include the mayor, city manager, city administrative\nofficer, or an administrative or directorial position. The term \"employee\" shall\nnot include the offices of the board of health, members of the planning and\nzoning commission, the board of trustees of the public library, members of the\nhousing authority, municipal hospital commission or the trustees, members or\ncorresponding officers of similar boards or commissions, persons employed\non temporary and special projects or to pe rsons whose regular employments\nwith the city are seasonal and are less than nine (9) months in any one (1)\nyear, persons in a class of employees designated by ordinance to be non -civil-\nservice positions, and the city clerk or city assessor; and\n(g) \"Pension fund\" means the moneys derived from the employees and the levy of\na special tax, either or both, or any other sum derived from any other source,\nto be used for the retirement of employees after the prescribed years of service\nand for the benefit of disa bled employees, and surviving spouses and\ndependent children in the case of death of an employee within the scope of his\nemployment according to the terms of KRS 90.310 to 90.410 and the\nordinance of the city.\n(2) The provisions of KRS 90.310 to 90.410 are  independent of and do not affect the\nlaws governing the police and fire departments, nor their pension funds, as provided\nin KRS Chapter 95.","path":["KRS Chapter 90"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43663","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:47Z","sha256":"85cdd7edcf8549af729d9ea498013cbe3dbe87a5348424a6d9a1c1e34b2c9452","source_id":"us-ky","stale":false,"prev":"us-ky/krs-90.240","next":"us-ky/krs-90.310"},"notice":"GroundRules: Original legal text.
