{"data":{"id":"us-ky/krs-91.501","jurisdiction":"us-ky","citation":"KRS 91.501","heading":"Consolidation of legal actions affecting the same land -- Effect of statute of","body":"limitations on pending actions -- Cross-claim for ad valorem tax.\n(1) (a) Any legal action to collect delinquent tax bills which may be pending at the\ntime of the c ommencement of any action brought under KRS 91.481 to\n91.527 affecting the same land shall be consolidated with the action brought\nunder KRS 91.481 to 91.527.\n(b) In any consolidated action:\n1. The parties to the pending legal action at the time of the com mencement\nof an action brought under KRS 91.481 to 91.527 shall file an answer or\nother responsive pleading in the consolidated action; and\n2. Any tax bill sought to be collected in any pending action may be\nincluded in any list in the petition filed by the collector.\n(c) All amounts due on any tax bill included under paragraph (b)2. of this\nsubsection in a consolidated action, including interest, penalties, and costs,\nshall be listed and charged, and the liens against the respective parcel of real\nestate listed in the petition filed pursuant to KRS 91.481 to 91.527 shall\ncontinue in force.\n(2) Any consolidated action described in subsection (1) of this section shall be tried as\nall other actions, and the statute of limitations shall not prevent the partie s to the\nprevious pending action from asserting all rights and defenses which they may\nhave.\n(3) Any cross-claim of a taxing authority under KRS 91.481 to 91.527 may include a\nclaim for the immediate enforcement of any ad valorem tax owed to the taxing\nauthority, notwithstanding KRS Chapter 134.","path":["KRS Chapter 91"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57364","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:48Z","sha256":"9d5f409dd733b1ba6c1d0c223d120c8fa732dfffa723304765957db3899c809e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-91.500","next":"us-ky/krs-91.504"},"notice":"GroundRules: Original legal text.
