{"data":{"id":"us-ky/krs-91.517","jurisdiction":"us-ky","citation":"KRS 91.517","heading":"Confirmation of sale by court -- Priority of distribution of proceeds.","body":"(1) After the master commissioner sells any parcel of real estate, the court shall, upon\nits own motion or upon motion of any interested party, set the matter for a hearing\nto confirm the sale, even if the parcels are not all of the parcels of real estate\ndescribed in the notice of the master commissioner's sale.\n(2) If the sale is confirmed, the court shall order the proceeds of the sale applied in the\nfollowing order:\n(a) To the payment of all costs, including court costs, publication costs, and costs\notherwise associated with the action and sale of the parcel described in the\nparticular count; and\n(b) To the payment of all tax bills on the property, including principal, in terest,\nand penalties.\n(c) If after the payment under paragraphs (a) and (b) of this subsection there\nremain any proceeds of the commissioner's sale of the property, the court shall\ndetermine the other issues in the suit with respect to that particular count.\n(d) If any of the answering parties has filed an appeal and executed an appropriate\nsupersedeas bond prior to the appeal, the court shall retain custody of the\nfunds pending disposition of the appeal, and upon disposition of the appeal\nshall make distribution.\n(e) If there are not sufficient proceeds of the sale to pay all claims in any class\ndescribed, the court shall order them to be paid in accordance with the\npriorities.\n(3) If there are any funds remaining of the proceeds after the commissione r's sale and\nafter the distribution of the funds as set out in this section and no person entitled to\nany funds, whether or not a party to the action, has appeared within two (2) years\nafter the sale and claimed the funds, the funds shall escheat to the st ate as provided\nin KRS Chapter 393.","path":["KRS Chapter 91"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57369","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:49Z","sha256":"621a0624f4eaf755afd93b6f8bc7ad6b643dbdebce65ea6399b5ac4e974eb67c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-91.514","next":"us-ky/krs-91.520"},"notice":"GroundRules: Original legal text.
