{"data":{"id":"us-ky/krs-91a.280","jurisdiction":"us-ky","citation":"KRS 91A.280","heading":"Payment of assessment or installment -- Lien.","body":"(1) After the passage of time for the action provided for in KRS 91A.270, or after\nfavorable final judgment in any such action, whichever comes later, the city may\nproceed with the improvement or part thereof as was stayed by the action, including\nnotice requiring payment of special assessment or installment thereon and bonds or\nother methods proposed to finance the improvement.  The first installment may be\napportioned so that other payments will coincide with payment of ad valorem taxes.\n(2) The amount of an y outstanding assessment or installments thereof on any property,\nand accrued interest and other charges, shall constitute a lien on the property to\nsecure payment to the bondholders or any other source of financing of the\nimprovement.  The lien shall take  precedence over all other liens, whether created\nprior to or subsequent to the publication of the ordinance, except a lien for state and\ncounty taxes, general municipal taxes, and prior improvement taxes, and shall not\nbe defeated or postponed by any private or judicial sale, by any mortgage, or by any\nerror or mistake in the description of the property or in the names of the owners.\nNo error in the proceedings of the city legislative body shall exempt any benefited\nproperty from the lien for the improvement assessment, or from payment thereof, or\nfrom the penalties or interest thereon, as herein provided.","path":["KRS Chapter 91A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25585","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:49Z","sha256":"509d8f6db096e2b069674cad9e9a1065aaede3461a261e147af3294eab8db637","source_id":"us-ky","stale":false,"prev":"us-ky/krs-91a.270","next":"us-ky/krs-91a.290"},"notice":"GroundRules: Original legal text.
