{"data":{"id":"us-ky/krs-91a.565","jurisdiction":"us-ky","citation":"KRS 91A.565","heading":"Ordinance establishing management district.","body":"(1) An ordinance establishing a management district shall include, but not be limited to,\nthe following provisions:\n(a) An accurate description of the boundaries of the management district\ndesignated either by map or perimeter description;\n(b) A description of  the economic improvements that may be undertaken within\nthe management district by its board, including but not limited to:\n1. The planning, administration, and management of development or\nimprovement activities;\n2. Landscaping, maintenance, and cleaning of public ways and spaces;\n3. The promotion of commercial activity or public events;\n4. The conduct of activities in support of business recruitment and\ndevelopment;\n5. The provision of security for public areas;\n6. The construction and maintenance of cap ital improvements to public\nways and spaces; and\n7. Any other economic improvement activity that specially benefits\nproperty;\n(c) A requirement that the legislative body approve the annual budget and annual\neconomic improvement plan for the district and es tablish a procedure and\nschedule for such approval;\n(d) The method of assessment of the properties that may include any fair basis\nauthorized by KRS 91A.200 to 91A.290;\n(e) The method for collection of the assessment;\n(f) The number of years, not exceeding five (5) years, that the assessments shall\nbe levied;\n(g) A method by which the annual increase in assessments caused by inflation,\nnew growth, and other factors shall be limited;\n(h) The makeup of the board for the manag ement district and its powers and\nduties; and\n(i) Any other provisions deemed necessary by the legislative body to implement\nthe provisions of KRS 91A.550 to 91A.580.\n(2) After the first reading of the ordinance to establish the management district, but\nprior to its second reading and passage, a public hearing on the question of the\nestablishment of the management district shall be held by the legislative body.\n(3) A summary of the proposed plan for the management district shall be published in a\nnewspaper in accordance with KRS Chapter 424 no less than twice, at least seven\n(7) but not earlier than twenty -one (21) days before the date of the public hearing.\nNotice shall also specify the date, time, and place of the hearing. In addition, a copy\nof the propos ed ordinance and the notice of the hearing shall be mailed, by first\nclass mail, to all property owners within the proposed management district.\n(4) After the public hearing, the legislative body may give second reading to the\nordinance that shall become e ffective if passed and approved pursuant to KRS\n83A.060.\n(5) After the establishment of a management district, the legislative body shall not\ndecrease the level of publicly funded services in the management district existing\nprior to the creation of the di strict or transfer the burden of providing the services,\nunless the services at the same time are decreased throughout the city.","path":["KRS Chapter 91A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25603","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:49Z","sha256":"b9b6ba70544973039020dd134bf164dd55f7a2a5bb4b8c824303baf85848ea38","source_id":"us-ky","stale":false,"prev":"us-ky/krs-91a.560","next":"us-ky/krs-91a.570"},"notice":"GroundRules: Original legal text.
