{"data":{"id":"us-ky/krs-94.815","jurisdiction":"us-ky","citation":"KRS 94.815","heading":"Appointment -- Terms -- Removal of members -- Status of authority.","body":"(1) A city parking authority shall consist of five (5) persons appointed by the mayor\nwith the approval of the city legislative body, to serve as commissioners of the local\nparking authority.  Three (3) of the commissioners who are first appointed shall be\ndesignated to serve for terms of one (1), two (2), and three (3) years, respectively,\nand the remaining two (2) of such commissioners shall be designated to serve for\nterms of four (4) years each, from the date of their appointment.  Upon expiration of\nthe staggered terms, the successors shall be appointed for a term of four (4) years.\nAppointments to complete unexpired terms of office shall be made in the same\nmanner as the original appointments.\n(2) A joint city-county parking authority shall consist of si x (6) commissioners.  Three\n(3) of the commissioners shall be appointed by the mayor with the approval of the\ncity legislative body.  Three (3) of the commissioners shall be appointed by the\ncounty judge/executive with the approval of the fiscal court.  Th e three (3)\ncommissioners who are first appointed by the mayor shall be designated to serve for\nterms of one (1), two (2) and three (3) years respectively and the same shall be true\nfor the commissioners initially appointed by the county judge/executive.  Upon\nexpiration of the staggered terms, the successors shall be appointed for a term of\nfour (4) years.  Appointments to complete unexpired terms of office shall be made\nin the same manner.\n(3) The commissioners shall constitute the governing body of the parking authority and\nshall adopt such bylaws, rules and regulations as are necessary for governing of the\nauthority.  Any commissioner may be removed from office upon a vote of a\nmajority of the members of the governing body which approved his appointment for\ninefficiency, neglect of duty, misfeasance, nonfeasance, or malfeasance, after at\nleast ten (10) days' written notice of the hearing to the member whose conduct is in\nquestion and to all members of the governing body.  At the hearing the member may\nbe represented by counsel and may appear personally and present such pertinent\nevidence as he wishes.  If after the hearing the governing body determines that he is\nguilty of the charges they shall remove the member from the authority within seven\n(7) days, and there shall be a vacancy of the office.\n(4) The commissioners of a motor vehicle parking authority are a body corporate\nconstituting a public corporation and a governmental agency within the meaning of\nKRS 58.010, and shall have all the powers granted by KRS 58.010 to 58.170.","path":["KRS Chapter 94"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=25931","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:54Z","sha256":"76aad4ec08932fa298f2c06b7fa89917a0e69ef8bd7148ecb3efe7ed80f0a933","source_id":"us-ky","stale":false,"prev":"us-ky/krs-94.810","next":"us-ky/krs-94.820"},"notice":"GroundRules: Original legal text.
