{"data":{"id":"us-ky/krs-95.550","jurisdiction":"us-ky","citation":"KRS 95.550","heading":"Benefits for disability or death from pension fund established under KRS","body":"95.520 -- Beneficiaries -- Amounts.\n(1) The pensions or benefits paid for disability or death from the policemen's and\nfirefighters' pension fund established under KRS 95.520 shall be as follows:\n(a) If any member of the police or fire department becomes temporarily totally\ndisabled, physically or mentally, while in the performance of duty and by\nreason of service in the department, the board of trustees of the pension fund\nshall order paid to him monthly, during his disability but not longer than one\n(1) year, a sum of not more than sixty dollars ($60) per month, the amount to\nbe determined by the board. This provision shall not apply if a salary is paid\nduring the same period. P rovided, however, that the provisions of this\nparagraph shall not apply unless the disabled firefighter or policeman has\nserved from one (1) day to ten (10) years consecutively in his department,\nsuch period of service to be fixed by the board of trustees;\n(b) If any member of the police or fire department becomes permanently disabled,\nphysically or mentally, while in the performance of duty and by reason of\nservice in the department, so as to render necessary his retirement from\nservice in the department, the board of trustees shall retire him from service\nand order paid to him monthly fifty percent (50%) of his monthly salary at the\ntime of his retirement. Provided, however, that the provisions of this\nparagraph shall not apply unless the disabled firefigh ter or policeman has\nserved from one (1) day to ten (10) years consecutively in his department,\nsuch period of service to be fixed by the board; and\n(c) If any member of the police or fire department is killed or dies as the result of\nan injury received in  the performance of duty, or dies of any disease\ncontracted by reason of his occupation, or dies while in the service from any\ncause as a result of his service in the department, or dies in service or while on\nthe retired list from any cause after fifteen (15) consecutive years of service in\nthe department, and leaves a widow, widower, or a child under eighteen (18)\nyears of age, the board of trustees shall order a pension paid to the widow,\nwidower, or child. There shall be paid monthly to the widow or wid ower,\nwhile unmarried, a pension of not less than thirty dollars ($30), or not more\nthan fifty percent (50%) of the deceased's monthly salary at the time of\nretirement or death and for each child until it reaches the age of eighteen (18)\nyears, not less than six dollars ($6) or not more than ten percent (10%) of the\ndeceased's monthly salary, such amount to be determined by the board of\ntrustees. The board may provide a minimum benefit of no more than four\nhundred dollars ($400) per month, initially, to the  surviving spouse if the\nbenefit can be supported on an actuarially -sound basis by the pension fund.\nThe board may increase the minimum benefit pursuant to the provisions of\nKRS 95.560. If the deceased member was unmarried and childless, a pension\nshall be paid to his dependent father and mother of not less than thirty dollars\n($30) or not more than twenty percent (20%) of the deceased's monthly salary.\nIf one (1) parent is dead, the other shall receive the entire amount, and if both\nare living, each shall receive one -half (1/2) the amount, such amount to be\ndetermined by the board of trustees.\n(2) No person shall receive a pension from the policemen's and firefighters' pension\nfund except as provided in this section.","path":["KRS Chapter 95"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43709","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:55Z","sha256":"e56e46b6d5c8a8650e05dfd44fccfbaf4cea2fe40eeb10d90b113c88b4c12d70","source_id":"us-ky","stale":false,"prev":"us-ky/krs-95.540","next":"us-ky/krs-95.560"},"notice":"GroundRules: Original legal text.
