{"data":{"id":"us-ky/krs-95.852","jurisdiction":"us-ky","citation":"KRS 95.852","heading":"Police and firefighters' retirement and benefit fund established in cities --","body":"Name -- Coverage provided in County Employees Retirement System after\nAugust 1, 1988.\n(1) There is hereby established in cities, a retirement and benefit fund for memb ers of\nthe police and fire departments, their dependents and beneficiaries, unless the\npolicemen and firefighters are included in the membership of the County\nEmployees Retirement System and certified to be working in hazardous positions.\nThe fund shall be  established as of July 1, 1956, and shall be known as the\n\"Policemen's and Firefighters' Retirement Fund of the City of ______.\" In such\nname all of its business shall be transacted, and in such name or nominee name as\nprovided by KRS 286.3 -225 all of its  moneys invested and all of its accumulated\nreserves consisting of cash, securities, and other property shall be held.\n(2) (a) After August 1, 1988, no new pension fund shall be created pursuant to this\nsection and cities which were covered by this section  on or prior to August 1,\n1988, shall participate in the County Employees Retirement System effective\nAugust 1, 1988;\n(b) Cities which were covered by this section on or prior to August 1, 1988, shall\nprovide for the retirement of police or firefighters re hired after August 1,\n1988, by placing such employees in the County Employees Retirement\nSystem;\n(c) Cities which were covered by this section on or prior to August 1, 1988, shall\nplace police or firefighters newly hired after August 1, 1988, in the County\nEmployees Retirement System;\n(d) Cities which were covered by this section on or prior to August 1, 1988, shall\noffer employees hired on or prior to August 1, 1988, membership in the\nCounty Employees Retirement System under the alternate participation pla n\nas described in KRS 78.530(3), but such employees may elect to retain\ncoverage under this section; and\n(e) The city shall certify that all police and firefighters placed in the County\nEmployees Retirement System are employed in hazardous positions.","path":["KRS Chapter 95"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44287","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:56Z","sha256":"49f35abecee79f3e8b8c657fdcc98b2a1ae2c569461a626bbb4b6f151607ce3c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-95.851","next":"us-ky/krs-95.853"},"notice":"GroundRules: Original legal text.
