{"data":{"id":"us-ky/krs-95a.040","jurisdiction":"us-ky","citation":"KRS 95A.040","heading":"Powers of commission -- Firefighter physical agility test -- Administrative","body":"regulations.\n(1) The commission shall make full and complete studies, recommendations and\nreports to the Governor, the Kentucky Community and Technical College System,\nand the Legislature for the purpose of establishing:\n(a) Minimum standards and education of fire protection personnel appointed to\npositions in municipal fire departments, who are to be engaged in fire\nprotection to include fire suppression, fire prevention, arson investigation, and\nother allied fields;\n(b) Basic minimum courses of training for fire protection personnel;\n(c) Procedure for the certification of fire protection personnel and the certification\nof fire protection instructors. The commission may provide  financial support\nfor certification, and this support may include the cost of training, training\naids, and salaries of instructors; and\n(d) Administrative regulations to require that each volunteer firefighter be able to\nread, write and understand the Eng lish language, is a person of sobriety and\nintegrity, is and has been an orderly, law -abiding citizen, is a citizen of the\nUnited States, a permanent resident of the United States, or otherwise lawfully\npresent in the United States, and has reached the age of eighteen (18).\n(2) (a) The commission shall establish by administrative regulation a candidate\nphysical agility test to be administered to all candidates for professional\nfirefighter positions. For the provisions of this section, \"professional\nfirefighter\" shall include any paid firefighter who is a member of a:\n1. Municipal fire department organized under KRS Chapter 95;\n2. Fire protection district organized under KRS Chapter 75;\n3. County fire department created pursuant to KRS Chapter 67;\n4. Fire department under the jurisdiction of a consolidated local government;\n5. Fire department under the jurisdiction of a charter county government;\n6. Fire department under the jurisdiction of an urban-county government;\n7. Fire department under the jurisdiction of a unified local government; or\n8. Fire department created under KRS Chapter 273.\n(b) The candidate physical agility test shall establish uniform standards of the\nphysical abilities required for all firefighter candidates. The candidate physical\nagility test shall be required for all firefighter candidates hired on or after\nJanuary 1, 2013.\n(c) After June 25, 2009, the commission shall establish procedures for individual\nfirefighter candidates to voluntarily take the  candidate physical agility test.\nThe commission shall also establish procedures for fire departments listed\nunder paragraph (a) of this subsection to voluntarily require firefighter\ncandidates hired by them to have successfully completed the candidate\nphysical agility test. The procedures in this paragraph shall be established by\nadministrative regulation.\n(d) The candidate physical agility test shall be designed to assess a candidate's\nability to handle the physical demands of fighting fires and shall inc lude\nexercises that simulate the most common tasks involved in fire suppression.\nThese exercises shall include but are not limited to stair climb, hose drag,\nequipment carry, ladder raise and extension, forcible entry, search, rescue,\nceiling breach, and pull.\n(e) The commission may establish a fee to be charged to candidates participating\nin the candidate physical agility test. The fee shall be no greater than an\namount specified by the commission to cover the costs of implementing and\nadministering the candidate physical agility test.\n(f) The commission shall promulgate administrative regulations, pursuant to KRS\nChapter 13A, to establish and implement the candidate physical agility test\nand to carry out any other responsibility assigned by this section. T he\nadministrative regulations shall be promulgated no later than October 1, 2009.\n(3) The commission shall have the authority to:\n(a) Certify fire protection training and education programs as having attained the\nminimum required standards suggested by the  commission, and provide\nfinancial support for the provision of training, training aids, and salaries of\ninstructors in order to achieve these minimum standards;\n(b) Certify instructors as having qualified as fire protection instructors under such\nconditions as the commission may prescribe;\n(c) Direct research in the field of fire protection and accept gifts and grants for\nsuch purposes; and\n(d) Recommend curricula for advanced courses and seminars in fire science\ntraining in colleges and institutions of higher education.\n(4) The commission shall have authority to receive and, to the extent required by\nfederal law, to disburse all grants and funds from the federal government for the\npurpose of fire protection personnel training and education. Except as other wise\nprovided by law, the commission shall administer all state programs and all state\nand federally funded grant programs related to fire protection personnel training and\neducation.","path":["KRS Chapter 95A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26133","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:56Z","sha256":"ed1f02d4d40243efb977e52f877959535a1efadd9d0b31627404811d643652b2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-95a.030","next":"us-ky/krs-95a.050"},"notice":"GroundRules: Original legal text.
