{"data":{"id":"us-ky/krs-95a.100","jurisdiction":"us-ky","citation":"KRS 95A.100","heading":"Fire investigators -- Appointment, oath, and training -- Peace officer","body":"powers -- Prohibited acts.\n(1) As used in this section and KRS 95A.102, \"fire investigator\" means a professional\nfirefighter, as defined in KRS 95A.210, who has been appoi nted to investigate\noffenses under KRS Chapter 513 and to exercise peace officer powers.\n(2) The chief of a fire department may appoint a professional firefighter, as defined in\nKRS 95A.210, to be a fire investigator and to exercise peace officer powers in order\nto investigate crimes set out in KRS Chapter 513 and other crimes discovered in the\ncourse of investigation.\n(3) An individual appointed to be a fire investigator and to exercise peace officer\npowers shall take an oath to faithfully perform the duti es of his or her office, shall\naffirm that he or she possesses the minimum qualifications under KRS 15.382, and\nshall undergo a basic training course approved by the Kentucky Law Enforcement\nCouncil.\n(4) The employing agency or jurisdiction of the fire inv estigator shall pay for the\ntraining required for certification by the Kentucky Law Enforcement Council.\n(5) Upon the Kentucky Law Enforcement Council's verification that the required\nstandards have been met, a fire investigator shall have peace officer po wers to\ninvestigate crimes set out in KRS Chapter 513 and other crimes discovered in the\ncourse of investigation.\n(6) A fire investigator may exercise his or her powers in a location other than the city\nor county in which he or she was appointed upon the request of:\n(a) The chief of police, the chief of a fire department, the sheriff, or the chief\nexecutive of the city or county in which the fire investigator's services are to\nbe utilized; or\n(b) A federal agency that has an ongoing investigation in the cit y or county in\nwhich the fire investigator's services are to be utilized.\n(7) A fire investigator shall not:\n(a) Patrol the roads, streets, or highways;\n(b) Issue traffic citations; or\n(c) Perform general law enforcement duties outside of investigating crimes set\nout in KRS Chapter 513 and other crimes discovered in the course of\ninvestigation.","path":["KRS Chapter 95A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54138","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:56Z","sha256":"0d71b889e2ccf9c2c4f9ec8d61ec213e7ab45cfcbda790de29e17e4f410c1eef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-95a.090","next":"us-ky/krs-95a.102"},"notice":"GroundRules: Original legal text.
