{"data":{"id":"us-ky/krs-96.150","jurisdiction":"us-ky","citation":"KRS 96.150","heading":"Extending water supply or sanitary sewer system outside city limits --","body":"Limitation -- Consideration of installation of fire hydrants on extended lines.\n(1) Any city that owns or operates a water supply or sanitary sewer system may extend\nthe system into , and furnish and sell water and provide sanitary sewers to any\nperson within, any territory contiguous to the city, and may install within that\nterritory necessary apparatus; provided, however, that the extension of a water\nsupply or sanitary sewer system  shall not enter into any territory served by an\nexisting water supply or sanitary sewer district unless such district requests the\nextension of water or sewer services from a city. For these purposes the city or\nsanitation authority established by an inte rlocal agreement may condemn or\notherwise acquire franchises, rights, and rights -of-way, as private corporations may\ndo.\n(2) When extending the system to any person, water district, or water association, the\ncity may consider the installation of fire hydra nts on the extended lines. The city\nmay extend water lines which are incapable of servicing fire hydrants only if the\ncity determines that servicing hydrants is not feasible. The determination shall\ninclude consideration of the incremental costs of adequat ely sized pipe and\nassociated pumps and towers, and the benefits of real estate development, water\nsales, the availability of fire protection insurance, and the reduction in fire insurance\npremiums which may result from the installation of hydrants at spec ified intervals.\nWhen extending lines to a water district or water association, the determination may\nbe made in consultation with the district or association, taking into consideration\ntheir fiscal capacity.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26180","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:57Z","sha256":"48340c6303288bb1aa96ac529cb3b8002628e5c13958dead10515b510712b5a0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.140","next":"us-ky/krs-96.160"},"notice":"GroundRules: Original legal text.
