{"data":{"id":"us-ky/krs-96.183","jurisdiction":"us-ky","citation":"KRS 96.183","heading":"Termination of operation under KRS 96.171 to 96.188.","body":"The governing body of the municipality may terminate the operation and management of\nthe electric and water plant by the board under the provisions of KRS 96.171 to 96.188\nonly by first complying with the following provisions, to wit:\n(1) The governing bod y of the municipality, upon the adoption of an ordinance\ndeclaring the desire of the municipality to terminate the operation of the electric and\nwater plant by the board under the provisions of KRS 96.171 to 96.188, may direct\nthat such question be submitt ed to an election of the qualified voters of the\nmunicipality. The mayor shall certify such ordinance to the county clerk not later\nthan the second Tuesday in August preceding the next general election, who shall\nhave prepared to be placed before the voter s in the general November election, the\nquestion: \"Are you in favor of the termination of the operation and management of\nthe electric and water system of the city by the Electric and Water Plant Board?\"\nThe voters shall be instructed to indicate a \"Yes\" or a \"No\" vote.\n(2) The mayor of such municipality shall advertise such election and the object thereof\nby publication pursuant to KRS Chapter 424, and also by printed handbills posted in\nnot less than four (4) conspicuous places in each voting precinct in the city and at\nthe courthouse door. All legal voters of such city shall be privileged to vote at such\nelection.\n(3) If two thirds (2/3) of all the qualified voters of the municipality voting in said\ngeneral election on the question shall vote in the affir mative, the governing body of\nthe municipality may adopt an ordinance rescinding its election to operate under the\nprovisions of KRS 96.171 to 96.188, and the board, on the first day of the month\nfollowing the passage and approval of such ordinance, shall by resolution transfer\nthe operation of the electric and water plant to the governing body of the\nmunicipality.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26196","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:57Z","sha256":"c71d84e6d7b6f2ccdf7d0c9a6aaee929bebc4fc31268d41ef2b58c342243ae1b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.182","next":"us-ky/krs-96.184"},"notice":"GroundRules: Original legal text.
