{"data":{"id":"us-ky/krs-96.540","jurisdiction":"us-ky","citation":"KRS 96.540","heading":"Restrictions on conveyance or encumbrance of waterworks or lighting","body":"system by a city of the home rule class.\n(1) Except as provided in KRS 96.171 to 96.188, inclusive, and in KRS 96.5405, no\ncity of the home rule class that owns a lighting system by gas or electricity, shall\nsell, convey, lease, or encumber the system or the income therefrom without the\nassent of a majority of the total number of legal voters of the city voting at an\nelection held for that purpose, after notice of the election has bee n published\npursuant to KRS Chapter 424.\n(2) In the case of a city with a population of less than eight thousand (8,000) based\nupon the most recent federal decennial census, the election shall be ordered and the\nelection officers shall be selected by the c ity legislative body, the city clerk shall\nprepare the question for presentation to the voters, and a tabulation of the vote shall\nbe done by the city legislative body in the presence of the mayor; in all other\nrespects the election shall be conducted under the regular election laws.\n(3) Except as provided in KRS 96.171 to 96.188, inclusive, and in KRS 96.5405, no\ncity of the home rule class that owns a waterworks system, shall sell, convey, lease,\nor encumber the system or the income therefrom without the assent of a majority of\nthe legislative body for the city or of a majority of the total number of legal voters\nof the city voting at an election held for that purpose, after notice of the election has\nbeen published pursuant to KRS Chapter 424.\n(4) This section shall not apply to the issuance of revenue bonds under the provisions of\nKRS 96.350 to 96.520.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43759","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:58Z","sha256":"c2336fe3ca224d98dfbb3ddb5e61127515c8db9f9f3c9dfe1705d04792432c54","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.5395","next":"us-ky/krs-96.5405"},"notice":"GroundRules: Original legal text.
