{"data":{"id":"us-ky/krs-96.600","jurisdiction":"us-ky","citation":"KRS 96.600","heading":"Procedure for condemnation -- Report of commissions -- Jury award --","body":"Procedure when condemnor not a utility.\n(1) When the board of any municipality authorized to acquire, construct, own or operate\nan electric plant under the provisions of KRS 96.550 to  96.900 shall be unable to\ncontract with the owner of any land, easement, right of way, electric plant, or any\nfacilities or property needed by such board for its use for the purposes thereof and\ndesires to exercise the right of eminent domain, the board s hall proceed to condemn\nthe property pursuant to the Eminent Domain Act of Kentucky except that, in lieu of\ndetermining the award to the owners in the manner prescribed in KRS 416.580(1)\nthe commissioners shall ascertain and determine the value of the prop erty taken; the\nvalue of real estate, tangible personal property, intangible property and franchises, if\nany such value is found to exist, shall be determined and stated separately in their\nreport; and they shall also award damages, if any, resulting to th e remainder of the\nelectric plant or system of the owner, considering the purposes for which the\nproperty is taken, and the amount of said damages, if any, shall be stated separately\nin their report. The jury award shall be made in this manner rather than in the\nmanner prescribed in KRS 416.660(1).\n(2) Notwithstanding the provisions of subsection (1) of this section, when the owner of\nany land, easement, right of way or facility to be acquired by exercise of the right of\neminent domain is not a utility, th e award to the owners thereof shall be determined\npursuant to the Eminent Domain Act of Kentucky.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26266","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:58Z","sha256":"6c5c14222ad2a11fc1f509835822fe031d891bf17ab471a3e74ad6a5b4089349","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.590","next":"us-ky/krs-96.610"},"notice":"GroundRules: Original legal text.
