{"data":{"id":"us-ky/krs-96.880","jurisdiction":"us-ky","citation":"KRS 96.880","heading":"Plant not subject to authority of Public Service Commission except as to","body":"extension of service -- Bonds do not require approval.\n(1) It shall not be necessary for any municipality proceeding under KRS 96.550 to\n96.900 to obtain any certificate of conven ience and necessity, license, permit, or\nother authorization, from any board, commission, or other agency of Kentucky, in\norder to acquire, maintain and operate any electric plant.\n(2) Neither the Public Service Commission of Kentucky nor any other board o r\ncommission of like character shall, unless in the future expressly authorized, have\njurisdiction over such board or municipality in the management and control of any\nelectric plant whether within or without its boundaries, or any power or authority\nover the regulation of rates or charges, except that the Public Service Commission\nmay, when it determines that such action is in the public interest and will not\njeopardize the financial structure of the system, require any such municipality to\nextend service within or without its boundaries to customers not previously served\nby such municipality. Its orders may be enforced by mandamus or mandatory\ninjunction.\n(3) If and when any board organized and operating under the provisions of KRS 96.550\nto 96.900 shall be required by the Public Service Commission to extend its services\nwithin or without its boundaries to customers not previously served by such\nmunicipality or board, revenue bonds may be issued and sold by the board in an\namount sufficient for the board to obtain all money necessary to pay the cost of such\nextended service.\n(4) Bonds may be issued under KRS 96.550 to 96.900 without respect to the provisions\nof any laws requiring the prior approval of any court, commission, board, or\nregulatory authority.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26294","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:58Z","sha256":"a6140319502b7208d5169fd587951aed8b434ec47cc1afc9ccb1352e1647e688","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.870","next":"us-ky/krs-96.890"},"notice":"GroundRules: Original legal text.
