{"data":{"id":"us-ky/krs-96.926","jurisdiction":"us-ky","citation":"KRS 96.926","heading":"User's appeal to Circuit Court.","body":"(1) Any sewer user, or prospective sewer user, affected by the Second Ordinance may,\nwithin thirty (30) days after publication of the Second Ordinance, file an action in\nthe Circuit Court of the county in which the city is situated attacking the validity of\nthe Second Ordinance from the standpoint of whether the governing body acted in\nconformity with the procedures made mandatory by KRS 96.910 to 96.927.\nProvided, however, that if any aggrieved sewer user or prospective sewer user files\nin the office of the ci ty clerk a written notarized statement of intent to file such an\naction, the time for filing actions in the Circuit Court shall be fifteen (15) days after\nsuch notice of intent to sue is filed with the clerk, or thirty (30) days after\npublication of the Second Ordinance, whichever is later.\n(2) Proceedings in the Circuit Court shall be tried according to the practice prescribed\nfor equity cases.\n(3) In the event an action is filed as provided for by this section, the effective date of\nthe proposed sewer ser vice charges as prescribed by the Second Ordinance shall be\nthe date judgment is entered by the Circuit Court, if such judgment is favorable.","path":["KRS Chapter 96"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26311","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:59Z","sha256":"09c7622f9fcd5a0f74e4c5ded346ae1fe1364073cf8605044048e99abda064b5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96.924","next":"us-ky/krs-96.927"},"notice":"GroundRules: Original legal text.
