{"data":{"id":"us-ky/krs-96a.095","jurisdiction":"us-ky","citation":"KRS 96A.095","heading":"Authorization for the Transportation Cabinet to accept funds for","body":"promotion  of, development  of, and provision of capital for mass  transit\nservices  and  human  service transportation delivery -- Authority to\npromulgate administrative regulations.\n(1) The Transportation Cabinet may receive and accept from the Commonwealth\nor any of its agencies, including the Cabinet for Health and Family Services\nand  the Department of Workforce Development, and from federal agencies\nappropriations or grants to promote, develop, and provide capital and operating\nsubsidies for mass transit services and human service transportation delivery in\nKentucky, and to receive and accept aid or contributions from any source of\neither money, property, labor, or other things of value to promote mass transit\nservices. Subject to the provisions of Section 230 of the Constitution of the\nCommonwealth  of Kentucky, any of these funds, property, or things of value\nreceived by the Transportation Cabinet may  be given directly to any of the\nfollowing entities in order to accomplish the purposes of this section:\n(a) A local transit authority as created under this chapter;\n(b) A city;\n(c) A county;\n(d) Other public mass transit providers;\n(e) A nonprofit or public mass transit provider operating under 49 U.S.C. sec.\n5310 or 5311; or\n(f) An entity providing human service transportation delivery.\n(2) The  Transportation Cabinet is authorized and  directed to apply for any\navailable federal funds for operating subsidies, either on a matching basis or\notherwise and to make  any of these funds received available to any of the\nfollowing entities in order to accomplish the purposes of this section:\n(a) A local transit authority as created under this chapter;\n(b) A city;\n(c) A county;\n(d) Other public mass transit providers;\n(e) A nonprofit or public mass transit provider operating under 49 U.S.C. sec.\n5310 or 5311; or\n(f) An entity promoting or providing transit services such as safety, planning,\nresearch, coordination, or training activities.\nIn those cases where federal laws or regulations preclude the Transportation\nCabinet from direct application for this type of federal funds, the cabinet is\nauthorized and directed to provide assistance to any of the entities listed in this\nsubsection as necessary to enable it to apply for and obtain this type of federal\nfunds in order to accomplish the purposes of this section.\n(3) The  Transportation Cabinet is authorized to assist cities and counties in the\nformation of local transit authorities in conformance with this chapter, but\nnothing in this chapter shall be construed as preventing the Transportation\nCabinet from providing assistance as authorized in this chapter to cities or\ncounties where local transit authorities do not exist.\n(4) The  Transportation Cabinet is authorized to contract, in accordance with the\nprovisions of KRS  Chapters 45A and 281, with a broker to provide human\nservice transportation delivery within a specific delivery area.","path":["KRS Chapter 96A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52335","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:59Z","sha256":"e0050abfb89ac6625d6be481100e90cc95b7f9a67684d0793934b51ee9a93eca","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96a.090","next":"us-ky/krs-96a.096"},"notice":"GroundRules: Original legal text.
