{"data":{"id":"us-ky/krs-96a.340","jurisdiction":"us-ky","citation":"KRS 96A.340","heading":"Publication of resolution or ordinance -- Framing of proposal -- Majority","body":"required -- Status of voted levies.\n(1) The resolution or ordinance of each public body determining that a proposition for\nthe establishment of a mass transportation program be submitted to the electorate of\nsuch public body or to the electorate of the transit area of such transit authority, as\nthe case may be, shall in each case be published in the newspaper having the largest\nbona fide circulation in the area affected and KRS 4 24.120 notwithstanding, in the\nfollowing manner:\n(a) The advertisement shall contain a notification that there is to be a referendum,\nthe subject of which is to be the proposed sales tax.\n(b) The advertisement shall contain the amount of the proposed sales  tax and the\nsubject(s) thereof.\n(c) The advertisement shall include the manner in which the tax shall be levied.\n(d) The advertisement shall include the manner in which and purposes for which\nrevenues resulting from the tax levy shall be spent.\n(e) The advertisement shall be no less than one-quarter (1/4) page in size, and\n(f) Shall be published at least once weekly for the nine (9) weeks immediately\nprior to the date of the referendum,\n(g) And daily for the week immediately prior to the date of the public ation in\nthose papers with daily publication.\n(h) The advertisement shall begin with the word \"Tax.\"\nThereafter such public body or public bodies shall cause the proposition to be\nprepared for submission to the electorate of either such public bodies or s uch transit\narea of the transit authority, as the case may be, at an election to be called and held\nfor such purpose. Such election may be held upon any date stipulated by the public\nbody or public bodies and shall be held pursuant to notice as prescribed in KRS\n424.130. Said election may, but need not, be held in conjunction with a regularly\nscheduled November election or a primary election as otherwise provided by law.\nThe proposal to be submitted to the electorate of such public body or public bodies,\nor transit area of such transit authority, as the case may be, shall be so framed that\nany voter who wishes to vote in favor of the mass transportation program and the\nfinancing source therefor may signify his approval by voting \"yes,\" and any voter\nwho wish es to vote against the mass transportation program and the funding\ntherefor may do so by voting \"no.\"\n(2) In the event any such mass transportation program proposal is submitted to the\nelectorate of any individual public body, such proposition and the sour ce of funding\ntherefor shall be approved if a majority of those voting on the proposal within the\npublic body shall vote \"yes.\"\n(3) In the event any such mass transportation program proposal is submitted to the\nelectorate of any transit area of any such tr ansit authority by simultaneous\nsubmission by all public bodies who are at the time of such submission members of\nsuch transit authority, such proposition and the source of funding therefor shall be\napproved if a majority of those voting on the proposal within the transit area of such\ntransit authority shall vote \"yes.\"\n(4) Any additional voted levies of ad valorem taxes approved by electorates pursuant to\nKRS 96A.310 to 96A.370, shall in the case of individual public bodies, be added to\nand constitute lega l tax levies of such individual public bodies within the meaning\nof the Constitution of Kentucky, and shall, in the case of votes taken in transit areas\nof transit authorities, constitute legal tax levies of each and every individual public\nbody which is a  member of any such transit authority within the meaning of the\nConstitution of Kentucky.","path":["KRS Chapter 96A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26350","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:59Z","sha256":"43214832d5ecff97ee671dd51e65093d88fb539a4a0d2f594818e3c5a68b57bb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-96a.330","next":"us-ky/krs-96a.350"},"notice":"GroundRules: Original legal text.
