{"data":{"id":"us-ky/krs-97.095","jurisdiction":"us-ky","citation":"KRS 97.095","heading":"Method for creating or joining regional park authority -- Powers -- Tax levy","body":"-- Governing board -- Compliance with KRS 65A.010 to 65A.090.\n(1) For the purpose of acquiring, building, operating, and maintaining parks and green\nspace, two (2) or more counties may form a regional park authority.\n(2) (a) The regional park authority may be established by a vote of the fiscal courts of\nthe participating counties or by a vote of the majority of the voters in each\nparticipating county voting in an election. The  issue shall be placed upon the\nballot if supported by a petition signed by a number of people from the\nparticipating counties equal to one percent (1%) of the voters in the last\nregular election.\n(b) A county may join an existing regional park authority b y a vote of the fiscal\ncourt of each participating county and of the fiscal court of the joining county,\nor by a vote of the majority of voters from each participating county and the\njoining county voting in an election. The issue shall be placed upon the ballot\nif supported by a petition signed by a number of people from the participating\nand joining counties equal to one per cent (1%) of the voters from each\nparticipating county and one percent (1%) of the voters from the joining\ncounty, voting in the last regular election.\n(3) A regional park authority is authorized to:\n(a) Levy taxes and issue bonds;\n(b) Accept donations, land, and equipment;\n(c) Reject unusable or unmanageable land donations;\n(d) Hire employees and contract for services; and\n(e) Enter into agreements with public and private entities under the provisions of\nthe Interlocal Cooperation Act, KRS 65.210 to 65.300, and contracts\nauthorizing the use of private facilities for public recreation.\n(4) A regional park authority may levy taxes not ex ceeding five cents ($0.05) on each\none hundred dollars ($100) of all taxable property within the regional park\nauthority's boundaries. The tax shall not be levied until a public referendum has\nbeen conducted in accordance with the provisions of KRS 83A.120  and has been\nadopted by the majority of the voters voting in an election in each county involved.\n(5) A regional park authority shall be governed by a board made up of three (3) citizens\nfrom each participating county. Board members shall be appointed by the fiscal\ncourt from a list of candidates provided by the cities within the county and by the\ncounty planning commission if there is one in that county.\n(6) A regional park authority shall comply with the provisions of KRS 65A.010 to\n65A.090.","path":["KRS Chapter 97"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41725","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:59Z","sha256":"fa28c2fb5091f864cb94087a011f26333fc23c82eab9e905f46f09f8f43f2879","source_id":"us-ky","stale":false,"prev":"us-ky/krs-97.090","next":"us-ky/krs-97.100"},"notice":"GroundRules: Original legal text.
