{"data":{"id":"us-ky/krs-97.120","jurisdiction":"us-ky","citation":"KRS 97.120","heading":"Appointment of recreational commission -- Members -- Terms -- Removal --","body":"Vacancies -- Rules and regulations -- Revenues -- Fees -- Compliance with KRS\n65A.010 to 65A.090.\n(1) In cities of the first class and in cities with populations equal to or gre ater than\ntwenty thousand (20,000) based upon the most recent federal decennial census, the\ncity recreational committee shall consist of not less than three (3) nor more than\nseven (7) members, the exact number to be at the discretion of the city legislati ve\nbody. In cities with populations of less than twenty thousand (20,000) based upon\nthe most recent federal decennial census, the city recreational committee shall\nconsist of three (3) members.\n(a) In cities of any class the city recreational committee sh all be appointed by the\nmayor, with the approval of a majority of the members of the legislative body\nof the city, for terms of four (4) years, except that the members first appointed\nshall be so appointed that the terms of the members will expire in diffe rent\nyears.\n(b) The members shall serve without compensation.\n(c) The members shall be legal voters of the city.\n(d) If any member during the term of his or her office becomes a candidate for, or\nis elected or appointed to any public office, he or she shal l automatically\nvacate his membership on the commission and another person shall be\nappointed in his or her place; but this provision shall not prevent a member of\nthe commission from serving as a member of any other appointive\ncommission of the city, county, state or federal government.\n(2) Any member of the commission may be removed by the vote of three -fourths (3/4)\nof the elected members of the city legislative body. Vacancies shall be filled in the\nsame manner as in the original appointment. The city m ay require each\ncommissioner to execute a bond in the penal sum of one thousand dollars ($1,000).\nIf the commissioners are required to execute bonds, the bonds shall be approved by\nthe legislative body of the city, and the cost thereof may either be paid by the city or\nby the commission out of its revenue.\n(3) The commission shall provide rules and regulations for the management of the\nrecreational project or projects, and out of the revenue derived from the project or\nprojects it shall pay all operating ex penses, provide for necessary repairs and\nadditions, provide a sufficient reserve fund to insure the buildings and\nimprovements against fire and tornado, provide a fund for payment of any\nincidental or emergency expenses that may arise, and set up a fund t o provide for\nthe payment of any debts created in connection with the establishment and\nmaintenance of the project or projects.\n(4) The commission may levy and collect fees for the use of or admission to the project\nor projects and expend or invest the inc ome from the fees for the purposes set forth\nin this section.\n(5) The commission shall comply with the provisions of KRS 65A.010 to 65A.090.","path":["KRS Chapter 97"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43761","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:49:59Z","sha256":"de875a82a92c46c4c89276d63c19545d93bca8cd0b134993b3075f64012a3955","source_id":"us-ky","stale":false,"prev":"us-ky/krs-97.110","next":"us-ky/krs-97.130"},"notice":"GroundRules: Original legal text.
