{"data":{"id":"us-ky/krs-97.630","jurisdiction":"us-ky","citation":"KRS 97.630","heading":"War memorial commissions in cities of the first class and the home rule","body":"class.\n(1) Any city of the first class that has constructed a war memorial under the provisions\nof Chapter 23 of the Acts of 1922 shall have a memorial commission consisting of\nseven (7) members. Members shall be not less than twenty -five (25) years of age\nand shall be bona fide residents of the county in which the city is situated. Upon the\nexpiration of the terms of the members of the commission appointed or elected\nunder the pr ovisions of Chapter 23 of the Acts of 1922, the remaining members of\nthe commission shall elect members to succeed those whose terms have expired, to\nserve for terms of seven (7) years each, and annually thereafter members to succeed\nthose whose terms have expired shall be elected for terms of seven (7) years each by\nthe remaining members of the commission. Vacancies in the terms of members\nshall be filled by the remaining members of the commission. Members selected to\nfill vacancies shall serve for the une xpired term. The members of the commission\nshall serve without compensation, but shall be allowed their necessary expenses for\ntravel when engaged on the business of the commission.\n(2) A city of the home rule class that has constructed a war memorial unde r the\nprovisions of Chapter 128 of the Acts of 1946, may, by ordinance, have a memorial\ncommission consisting of fifteen (15) members. Members of the commission shall\nbe nominated and appointed by the mayor and approved by the city legislative body.\nFive ( 5) of said members shall be appointed to serve five (5) years; five (5)\nmembers shall be appointed to serve six (6) years; and five (5) members shall be\nappointed to serve seven (7) years. Thereafter, members to succeed those whose\nterms have expired shall  be elected by the remaining members of the commission\nfor terms of three (3) years. Vacancies in the terms of members shall be filled by the\nremaining members of the commission. Members selected to fill vacancies shall\nserve for the unexpired term. The me mbers of the commission shall serve without\ncompensation, but shall be allowed their necessary expenses for travel when\nengaged in the business of the commission.\n(3) In lieu of the requirements of subsection (2) of this section, the legislative body of\nany city of the home rule class may enact an ordinance to establish an alternative\nnumber of members, not less than five (5), to serve on the city's war memorial\ncommission, each for a term of three (3) years. The appointment, filling of\nvacancies, and compe nsation of members appointed pursuant to this subsection\nshall be governed in the same manner as provided in subsection (2) of this section.\nA city acting pursuant to this subsection that establishes a number of members less\nthan are currently serving shall not require the removal of any serving member, but,\nupon expiration of the term, shall not fill such position, to ensure that the number of\nmembers equals that which the city has provided in the ordinance.","path":["KRS Chapter 97"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44958","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:00Z","sha256":"8cd9dafc98e248633c410aa01558070600e842f78244267aa96de79e7cb172d5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-97.620","next":"us-ky/krs-97.640"},"notice":"GroundRules: Original legal text.
