{"data":{"id":"us-ky/krs-98.090","jurisdiction":"us-ky","citation":"KRS 98.090","heading":"Powers of commission.","body":"(1) The commission may:\n(a) Make such preliminary investigations and do such preliminary work as\nshould, in its judgment, precede the actual construction of the building or\nimprovement.\n(b) Determine upon a proper site for the building or improvement. If the city\nowns a public build ing, that site, as it exists or as enlarged by the acquisition\nof adjacent property recommended by the commission, shall be used unless\nthe commission determines that it is unsuitable for the purpose and\nrecommends to the mayor the acquisition of another s ite. The mayor shall\nsubmit the recommendation to the legislative body for approval. The new site\nshall be adopted only upon the approval of the change by legislative resolution\napproved by the mayor. In the event the existing building on the old site is t o\nbe abandoned, the old site may be sold and the proceeds applied to the\npurchase of the new site.\n(c) Provide accommodations for patients or inmates of the existing public\nbuilding while the new building is in course of erection and furnishing. The\nlegislative body may, out of its levy for the department having supervision of\nsuch buildings, assume the whole or part of the expense of providing such\ntemporary accommodations.\n(d) Establish and enforce reasonable rules and regulations for its own government\nand for the supervision, protection, management and conduct of its work and\nthe payment therefor as it deems expedient.\n(e) Purchase, hire or otherwise obtain the use of such lands, buildings, machinery,\nsupplies, materials and working agencies as it needs for its purposes.\n(f) Acquire by gift, purchase, lease or condemnation, any property situated within\nthe city or county where the city is located, or any interest or privilege in the\nproperty, required for the building or improvement. The method of\ncondemnation shall be the same as in the Eminent Domain Act of Kentucky.\n(2) The enumeration of special powers in this section does not restrict the general\npowers of the commission to carry out the purposes of KRS 98.040 to 98.170.","path":["KRS Chapter 98"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=26470","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:01Z","sha256":"95242eb9e84556cbc09d76d941059415b9a56eaaa2b5a8dc458c322a69c752c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-98.080","next":"us-ky/krs-98.100"},"notice":"GroundRules: Original legal text.
