{"data":{"id":"us-ky/krs-98.340","jurisdiction":"us-ky","citation":"KRS 98.340","heading":"By agreement department may assist in administering or administer any","body":"state or local welfare function -- Agreement to be in writing.\n(1) The department may administer or assist in administering any state or local public\nwelfare function by agreement be tween the fiscal court and the legislative body or\nofficers, department, or agency in which the responsibility for administration of\nsuch activity is vested. Such agreements may include the performance of any duties\nand the exercise of any powers imposed u pon or vested in such legislative body or\nofficer, department, or agency, with respect to the administration of such function.\nSuch agreement shall be in writing by the other party to the agreement, in the\nnecessary form, and the acceptance shall be in the  form of a resolution of the fiscal\ncourt. When such resolution becomes effective, the exercise of the powers and\nduties to which the agreement relates, including those provided in KRS 98.010,\nshall be transferred to the department, and the other party sha ll be exempt from all\nfurther responsibility for the exercise of the powers and duties so transferred during\nthe life of the agreement.\n(2) Such agreement may be revoked at the option of either party by a resolution or\nordinance or order of the revoking party filed in the office of the county clerk, and a\ncopy shall be delivered to the other party. Such revocation shall become effective at\nthe end of the fiscal year occurring at least one (1) year following the filing of said\nresolution or order.
